An emergency exists in the usual daily operations of the Recreation and Parks Department in that it is immediately necessary to enter into said contract so that construction may occur during the current construction season.

To authorize and direct the Director of Recreation and Parks to enter into contract with Columbus Asphalt Paving, Inc. for the Alum Creek Trail - Stone Cliff Connector Project; to authorize the expenditure of a base bid of $76,621.50 and a contingency of $1,633.50 for a total of $78,255.00 from the Voted Recreation and Parks Bond Fund 702; to amend the 2011 Capital Improvements Budget, and to declare an emergency. WHEREAS, proposals were received by the Recreation and Parks Department on March 29, 2011 for the Alum Creek Trail - Stone Cliff Connector Project; and
WHEREAS, the 2011 Capital Improvement Budget will be amended to reflect cancellations within project; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into contract with Columbus Asphalt Paving, Inc. so that construction may occur during the current construction season, thereby preserving the public health, safety and welfare of the public; NOW, THEREFORE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Recreation and Parks be and is hereby authorized to enter into contract with Columbus Asphalt Paving, Inc. for the Alum Creek Trail - Stone Cliff Connector Project.
SECTION 2. That the expenditure of $78,255.00, or so much thereof as may be necessary, be and is hereby authorized from the Voted Recreation and Parks Voted Bond Fund No. 702, Dept. 51-01 as follows:

SECTION 3. That the 2011 Capital Improvements Budget Ord. # 0266-2011 is hereby amended as follows, in order to provide sufficient budget authority for this legislation and future projects:

SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this legislation
SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or 10 days after passage if the Mayor neither approves nor vetoes the same.
