Title: To authorize the Director of the Department of Public Utilities to execute those documents necessary to grant Delaware County certain temporary construction easements through certain City owned real property located in the vicinity of State Route 257 and Hoskins Road, in order that Delaware County may replace portions of the Hoskins Road Bridge and to declare an emergency.
Explanation
 
Background:    The City of Columbus is the owner of certain real property located in the vicinity of State Route 257 and Hoskins Road, Delaware County, Ohio.  Delaware County is engaged in its DEL-CR 183 Hoskins Road 183 Project, and desires to replace certain portions of the Hoskins Road Bridge.  In order to provide the required right-of-way necessary to the project, the Delaware County Engineer has requested that the City grant Delaware County certain temporary easements, more fully described in the body of this legislation.  After investigation by the Department of Public Utilities, it has been determined that the granting of the subject easements will not adversely affect the City and may be granted.  The Department of Law, Real Estate Division, has determined a value of $72.00 for the aforementioned easements.  The following legislation authorizes the Director of the Department of Public Utilities to execute those instruments necessary to grant the subject easements to Delaware County for their DEL-CR 183 Hoskins Road 183 Project.
 
Fiscal Impact:    The $72. 00 to be received by the City, as consideration for the granting of the subject easements, shall be deposited in the appropiate City fund.
 
Emergency Justification:   This request has been thoroughly investigated and contemplated by the Division of Sewers and Drains and at this time emergency action is requested by the Division of Real Estate in the spirit of inter-governmental cooperation to allow this matter to proceed without delay

To authorize the Director of the Department of Public Utilities to execute those documents necessary to grant Delaware

Body
 
WHEREAS, the City of Columbus is the owner of certain real property located in the vicinity of State Route 257 and Hoskins Road, Delaware County, Ohio; and
 
WHEREAS, Delaware County is engaged in its DEL-CR 183 Hoskins Road 183 Project, and desires to replace certain portions of the Hoskins Road Bridge; and
 
WHEREAS, in order to provide the required right-of-way necessary to the project, the Delaware County Engineer has requested that the City grant Delaware County certain temporary easements, more fully described in the body of this legislation; and
 
WHEREAS, after investigation, it has been determined that the granting of the subject easements will not adversely affect the City and should be granted; and
 
WHEREAS, the Department of Law, Real Estate Division, has determined a value of $72.00 for the aforementioned easements; and
 
WHEREAS, an emergency exists in the usual daily operation of the City of Columbus, that it is immediately necessary to authorize the Director of Public Utilities to execute those documents, as approved by the Real Estate Division, Department of Law, necessary to grant Delaware County certain temporary easements in, under, across, over and through certain Cityowned real property located in the vicinity of State Route 257 and Hoskins Road, Delaware County, Ohio for the immediate preservation of the public health, peace, property and safety; now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.      That the Director of the Department of Public Utilities be and hereby is authorized to execute those documents prepared by the Department of Law, Real Estate Division necessary to grant Delaware County the following described easements in, under, across, over and through certain real property located in the vicinity of State Route 257 and Hoskins Road, as requested by Delaware County, to wit:

DEL-CR183-02.88
      Situated in the State of Ohio, County of Delaware, Thompson Township, part of Lot 14, Survey Number 3021 in the Virginia Military Lands, further described as follows:
      Being a parcel of land lying on the left side of the centerline of a survey of County Road 183 (Hoskins Road) made by the Delaware County Engineer, and recorded in Book _____, Page _____, of records of Delaware County and being located within the following described points in the boundary thereof;
      Beginning at a point on the existing northerly right-of-way line of Hoskins Road on an easterly property line of that 103.00 acre tract of land conveyed to the City of Columbus, Ohio by deed recorded in Volume 0565, Page 220, said point being located at DEL-CR183 Centerline of Survey & Construction Station 11+44.41, 30.00 feet Left;
      Thence N 71º 30' 37" W, for a distance of 114.63 feet, along the existing northerly right-of-way line of Hoskins Road, crossing said 103.00 acre tract to a point on the existing easterly right-of-way line of State Route 257 at Station 10+29.78, 30.00 feet Left;
      Thence N 09º 23' 31" E, for a distance of 14.18 feet, along the existing easterly right-of-way line of State Route 257, crossing said 103.00 acre tract to a point at Station 10+27.54, 44.00 feet Left;
      Thence S 71º 30' 37" E, for a distance of 120.18 feet, crossing said 103.00 acre tract to a point on said easterly property line, at Station 11+47.72, 44.00 feet Left;
      Thence S 31º 47' 16" W, for a distance of 14.39 feet, along said easterly property line, to the Place Of Beginning, and containing 0.038 acres of land, more or less.
      Said stations being the station numbers as stipulated in the hereinbefore-mentioned survey and as shown by plans DEL-CR183 on file in the Delaware County Engineer's Office, Delaware, Ohio.
      All bearings shown are for this project use only.  The bearings for this description were established by a survey performed by Jones-Stuckey Ltd., Inc. in the year 2003 under the supervision of Dwight D. Stuckey, Ohio registered surveyor number 4992, and are based on an assumed meridian.

      Thence S 13º 46' 04" W, for a distance of 15.05 feet along an easterly property line of said 103.00 acre tract to a point at Station 11+41.04, 45.00 feet Right;
      Thence N 71º 30' 37" W, for a distance of 99.24 feet, crossing said 103.00 acre tract, to a point on the existing easterly right-of-way line of State Route 257 at Station 10+41.79, 45.00 feet Right;
      Thence N 09º 23' 31" E, for a distance of 15.19 feet, along the existing easterly right-of-way line of State Route 257, crossing said 103.00 acre tract to a point at Station 10+39.39, 30.00 feet Right;

      Section 2.      That the City Auditor is hereby authorized and directed to deposit the Seventy Two Dollars ($72.00), to be received by the City, as consideration for the granting  of the subject temporary easements, in the appropriate City fund.
 
      Section 3.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
