APPLICANT:  Anthony Thomas Candy Co.; c/o David Hodge and Jeffrey L. Brown, Attys.; Smith and Hale LLC; 37 West Broad Street, Suite 725; Columbus, OH 43215.
      
PROPOSED USE:  Medical health center.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-0) on February 10, 2011.
 
FRANKLINTON AREA COMMISSION RECOMMENDATION: Approval.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The 0.93± acre site is developed with an office/warehouse building zoned in the M, Manufacturing District.  It was recently discovered that the rear portion of the building and the parking lot are zoned in the R-4, Residential District.  The applicant requests the L-M, Limited Manufacturing District for the entire building site to correct the residential zoning and will allow a conversion to a medical health center while still retaining manufacturing uses.  The site is located within the planning area of The Franklinton Plan (2003), which recommends commercial development along West Broad Street and single-family residential development for the rear portion of the site.  Since the majority of the site is zoned in the M District, abuts railroad tracks, and has been historically used for industrial purposes, Staff is supportive of the requested L-M District which also allows commercial uses and contains appropriate use restrictions.  The request is consistent with the zoning and development patterns in the area.

WHEREAS, application #Z10-029 is on file with the Building and Zoning Services Department requesting rezoning of 0.93± acres from M, Manufacturing, and R-4, Residential Districts, to L-M, Limited Manufacturing District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the Columbus Public Health Healthy Places program reviews applications for active living features and recognizes that this development has pedestrian signage at the entrance/exit to the existing on-site parking lot to alert motorists to pedestrians crossing along Yale Avenue; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested L-M, Limited Manufacturing District will secure proper zoning for the rear portion of the building and parking lot, and will allow the building to be re-used for a medical health center while retaining industrial uses. The request is consistent with the zoning and development patterns in the area, now, therefore:    
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
1160 WEST BROAD STREET (43222), being 0.93± acres located at the northeast corner of West Broad Street and North Yale Avenue, and being more particularly described as follows:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, being Lots 1 thru 13 of that subdivision entitled "Franklin Subdivision No. 2", of record in Plat Book 4, Page 357, and that alley vacated by Ordinance Number 999-82, as conveyed to Anthony Thomas Candy Company by deeds of record in Official Record 3328A01, Official Record 1880J16, Official Record 1854E01, Official Record 1770G20, and Official Record 11706C04 (all references refer to the records of the Recorder's Office, Franklin County, Ohio), and being described as follows:
 
BEGINNING at a northwesterly corner of said Lot 13, a southwesterly corner of Lot 14 of said "Franklin Subdivision No. 2", as conveyed to Jo Ellen Allen by deed of record in Official Record 17977A07, being the easterly right-of-way line of Yale Avenue (50');
 
thence North 90° 00' 00" East, with the northerly line of said Lot 13, a distance of 106.50 feet to a point at the southeasterly corner of said Lot 14, being in the westerly line of a 14' Alley;

SECTION 2.  That a Height District of thirty-five (35) feet is hereby established on the L-M, Limited Manufacturing District on this property.
 
SECTION 3.  That the Director of the Department of Building and Zoning Services be, and is hereby authorized and directed to make the said changes on the said original zoning map and shall register a copy of the approved L-M, Limited Manufacturing District and Application among the records of the Department of Building and Zoning Services as required by Section 3370.03 of the Columbus City Codes; said text titled, "LIMITATION TEXT," signed by Jeffrey L.
