Explanation
 
BACKGROUND:  This ordinance authorizes the Finance and Management Director to enter into contract for the Office of Construction Management with Gutknecht Construction Company, Inc., for the construction of the West Side Family Health Center, to be located in the vicinity of 2300 West Broad Street.  This project will be a LEED (Leadership in Energy and Environmental Design) Silver Certified building, in compliance with the Mayor's Get Green Columbus initiative.  LEED is administered by the United States Green Building Council, and is the nationally accepted benchmark for the design, construction, and operation of high performance green buildings.  LEED components in this project will include highly efficient lighting, energy efficient windows that also allow more natural light into the building, energy efficient HVAC systems, the use of recycled buildings materials, LEED certified insulation for energy efficiency, and a bioswale that will keep approximately 90% of storm water on the site.  LEED Silver is a higher ranking than the basic LEED Certified ranking.  This construction will also include major renovations of the site's main electric power distribution.
 
Formal bids were solicited on January 3, 2008 and eight companies submitted bids on January 31, 2008 as follows (0 MBE, 0 FBE):

The Office of Construction Management recommends the bid award be made to the most responsive and responsible and best bidder, Gutknecht Construction Company, Inc.  
 
EMERGENCY ACTION is requested to ensure the construction of the new health center begins as soon as possible, thereby providing necessary health services to the residents of the West side.
 
Gutknecht Construction Company, Inc.  Contract Compliance Number 31-0935568, expiration date 09-10-2009.
 
FISCAL IMPACT:  The Construction Management Capital Improvements Budget includes $7,600,000.00 for the West Side Family Health Center project.  The Public Utilties Department Capital Improvements Budget includes $400,000.00 for the West Side Family Health Center project.  The cost of this contract is $6,139,200.00.  Of this, $5,824,200 for construction.  The contract includes a contingency of $315,000.00.    Previous ordinances have approved $430,077.06 for dental and medical equipment.

WHEREAS, it is necessary to construct a new West Side Family Health Center, to be located in the vicinity of 2300 West Broad Street, and
 
WHEREAS, formal bids were solicited for the construction of said new health center, and
 
WHEREAS, the Office of Construction Management recommends Gutknecht Construction Company, Inc. as the most responsive and responsible bidder and best bidder, and
 
WHEREAS, it is necessary for the Electricity Division to provide funding for the renovation of the main electric power distribution, and
 
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Office of Construction Management, in that it is immediately necessary to authorize the Finance and Management Director to enter into contract with Gutknecht Construction Company Inc., for the construction of the new West Side Family Health Center, thereby ensuring that necessary health services are provided to the families of the West Side, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Finance and Management Director is hereby authorized to enter into contract for the Office of Construction Management with Gutknecht Construction Company, Inc. for the construction of the new West Side Family Health Center, to be located in the vicinity of 2300 West Broad Street.
 
SECTION 2.  That the expenditure of $6,139,200.00, or so much thereof as may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.  
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
