Explanation
1. This ordinance authorizes the Director of Public Utilities to contract for repairs in anticipation of entering into an agreement between the City of Columbus and the City of Upper Arlington to collaborate on an effort to enable the positive adaptive reuse of "Richard's House", formerly known as the "Dam Tender's House", which is located within the City of Columbus on property owned by the Department of Public Utilities and maintained as a portion of the Division of Power and Water's Grigg's Reservoir and park system.
The structure at issue is a stone house of historical interest which is located on the property of Grigg's Reservoir. It is owned by the Department of Public Utilities, Division of Power and Water. Earlier this year, the City determined that the structure could not be rehabilitated for a useful water utility purpose and that security of the structure presented an on-going concern. While all parties are not eager to destroy the structure because of its intrinsic historical value, the City of Columbus does not have the resources to restore it for any future public function.
The City of Upper Arlington has indicated that it may be is interested in rehabilitating the building in a manner that would make it eligible for registry on the National Register of Historic Places. Potential future uses may include housing It would subsequently use the building to house the Upper Arlington Historical Society. The Upper Arlington Department of Parks and Recreation intends also contemplates the creation of to create a public garden adjacent to the structure. The City of Upper Arlington is contemplating whether it would be feasible to site a commercial use, such as a restaurant similar to a "Tavern on the Green," at this location.
In order to maintain the option of the future potential adaptive reuse of the building, this ordinance authorizes Wwaiving of competitive bidding provisions of Columbus City Codes for immediate stabilizing repairs. is also requested. If the property is to be properly secured before the onset of winter there is insufficient time to secure competitive bids and present contracting legislation to City Council.
2. FISCAL IMPACT: The Division of Power and Water is requesting an amendment to the 2006 Capital Improvements Budget for purposes of establishing sufficient budget authority for this expenditure. Additionally, a transfer of funds within the Waterworks Enlargement Voted 1991 Bonds Fund is required in order to expend up to $200,000.00 for this project.

($200,000.00)

WHEREAS, parties to the agreement will be the City of Columbus, as represented by the Director of Public Utilities, and the City of Upper Arlington; and
WHEREAS, the total area leased will include the stone structure and such surrounding area necessary to meet the needs of the ultimate use of the property; and
WHEREAS, the property surrounding the house must remain free and open to the public; and
WHEREAS, the City of Columbus will utilize up to $200,000.00 to secure the building for winter (including some masonry, framing, new roof on older portion of the house, tarping over remainder of the house, and security fencing); and
WHEREAS, waiving of competitive bidding provisions of Columbus City Codes is also requested. If the property is to be properly secured before the onset of winter there is insufficient time to secure competitive bids and present contracting legislation to City Council, and
WHEREAS, the City of Upper Arlington will thereafter assume responsibility for the restoration, repair, and maintenance of the structure consistent with efforts to place the structure on the National Register of Historical Places; and
WHEREAS, all use of the property must be compatible with the location of the property within the reservoir and that judgment of compatibility is within the sole discretion of the City of Columbus; and
WHEREAS, recognition that the property is located within the City of Columbus and as such all City Code requirements, including but not limited to zoning, parkland, and stormwater management , govern the site; and
WHEREAS, the base price of the lease is $1.00; and
WHEREAS, all sub-leasing arrangements must be approved by Columbus City Council; and
WHEREAS, if the City of Upper Arlington pursues a commercial venture on this site, additional payments will be due to the City of Columbus based on a (50/50) split of proceeds after the City of Upper Arlington recovers its costs for restoration, maintenance, and operations; and
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Waterworks Enlargement Voted 1991 Bonds Fund; and
WHEREAS, it is necessary to authorize an amendment to the 2006 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditures; and now, therefore
WHEREAS, if the City of Upper Arlington does not restore the structure and place it back in positive adaptive reuse within five years of the initiation of the lease, the lease will terminate and the City of Upper Arlington will repay the City of Columbus $200,000.00; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Auditor is hereby authorized to transfer $200,000.00 within the Waterworks Enlargement Voted 1991 Bonds Fund, Fund 606, Division of Power and Water, Division 60-09, Object Level One 06, Object Level Three 6620, as follows:

SECTION 2. That the Director of Public Utilities be, and is hereby authorized to enter into contract for immediate stabilizing repairs to an agreement between the City of Columbus and the City of Upper Arlington to collaborate on an effort to enable the positive adaptive reuse of "Richard's House", formerly known as the "Dam Tender's House", which is located within the City of Columbus on property owned by the Department of Public Utilities and maintained as a portion of the Division of Power and Water's Grigg's Reservoir and park system.
SECTION 3. That it is in the best interest of the City to waive the provisions of Section 329.06 of the Columbus City Codes, 1959, and such provisions are hereby waived.
SECTION 4. That the expenditure of $200,000.00, or as much thereof as may be needed, is hereby authorized from the Waterworks Enlargement Voted 1991 Bonds Fund, Div. 60-09, Fund 606, Project No. 690416, OCA Code 690416, and Object Level Three 6620.
SECTION 5. That the 2006 Capital Improvements Budget Ordinance No. 1108-2006 is hereby amended as follows, to provide sufficient budget authority for the execution of the agreement stated in Section 2 herein.
