Explanation
 
1.  Background:  This legislation authorizes the Director of Public Utilities to enter into an agreement with Braun & Steidl Architects for preliminary professional design services for the Utilities Complex Improvements, Customer Service Center, for the Department of Public Utilities.  In order to improve internal operations and better serve the ratepayers, the Department is evaluating the construction of a customer service facility that will provide convenience to water and sewer service customers and private developers.  The actual emplacement of the designed work will be through a construction contract.  The proposed facility is planned to be located south of the Utilities Complex Building at 910 Dublin Road, Columbus Ohio, 43215.
 
This legislation authorizes the expenditure for preliminary professional design service and site condition evaluation.  The expenditure for detailed design services and construction administration services may be authorized by a future legislative modification when the scope of services can be better defined.  These future services would consist of: detailed design, bidding assistance, construction-phase engineering, construction management, start-up and commissioning assistance, record documentation preparation assistance, and other services for this project, as directed by the City.
 
2.  Procurement Information:  The Department of Public Utilities determined that these professional design services are necessary to successfully implement this important project, and that the services cannot be performed by City personnel at this time.  In consequence, a procurement conforming to the Request for Proposals (RFP) process in 329.14 of Columbus City Codes was conducted, as follows:
 
1.      Written notice of the procurement process was furnished to City Council on 4/20/06.
2.      The RFP was prepared and published in the City Bulletin beginning 6/19/06.
3.      Information packages were made available to Offerors beginning 6/19/06.
4.      An informational meeting was held for Offerors on 6/27/06.
5.      Proposals were received from Offerors on 7/17/06.
6.      Four Proposals were received by the City.
7.      A five-person Evaluation Committee of Division and Department personnel reviewed the Proposals, achieved a unanimous ranking, and reported the ranking on 9/29/06.
8.      The Administrator of Sewerage and Drainage concurred in the ranking on 10/04/06; the Administrator of Power and Water concurred in the ranking on 10/10/06; and Director of Public Utilities concurred in the ranking on 10/19/06.
9.      The Offerors were notified of their ranking and negotiations began with the highest-ranked Offeror, Braun & Steidl Architects.
10.      Negotiations have resulted in this Ordinance, to allow this important work to commence.

3.  FISCAL IMPACT:  A transfer of funds is required from the Division of Power and Water's Water Works Enlargement Voted 1991 Bonds Fund in order to cover this expenditure.  There is sufficient funding available in the Voted Sanitary Bond Fund.  There is also sufficient budget authority in the 2006 Capital Improvements Budget.
 
The legislation for preliminary design services is in the amount of $298,295.00.  This contract may be modified to provide needed monies for the next phase as the project proceeds, and as necessary for any anomalies in the work which may become evident later.

WHEREAS, the Department is evaluating the construction of a customer service facility that will provide convenience to water and sewer service customers and private developers; and
 
WHEREAS, the City has conducted a procurement process seeking preliminary professional design services; and
 
WHEREAS, the department may request a future legislative modification for detailed design services and construction administration services for the Utilities Complex Improvements, Customer Service Building, when the scope of services can be better defined; and
 
WHEREAS, a transfer of funds is needed within the Water Works Enlargement Voted 1991 Bonds Fund for the Utilities Complex Improvements, Customer Service Center project; and
 
WHEREAS, it has become necessary in the usual daily operation of the Divisions of Water and Power and Sewerage and Drainage, Department of Public Utilities; to authorize the Director of Public Utilities to enter into an agreement for preliminary professional design services; for the Utilities Complex Improvements, Customer Service Center project; for the preservation of the public health, peace, property and safety; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities be, and hereby is, authorized to execute an agreement with Braun & Steidl Architects, 234 North Fifth St., Columbus, OH 43015, for preliminary professional design services for the Department of Public Utilities, Utilities Complex Improvements, Customer Service Building project, in accordance with the terms and conditions of the agreement on file in the offices of the Department of Public Utilities.
 
SECTION 2.  That the said firm shall perform the work to the satisfaction of the Director of Public Utilities, the Administrator of the Division of Sewerage and Drainage and the Administrator of the Division of Power and Water.
 
SECTION 3.  That the City Auditor is hereby authorized to transfer $149,147.50, Division 60-09, Object Level One 06, Object Level Three 6682, as follows:

SECTION 4.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
SECTION 5.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
SECTION 6.  That for the purpose of paying the cost of the professional engineering services contract, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows:
