..Explanation  
Ordinance #1617-02E, passed by City Council on November 4, 2002, authorized the Public Service Director to enter into an agreement with the Central Ohio Transit Authority (COTA) for construction of the Front Street Abutment Relocation improvement.  This improvement is part of COTA's proposed multi-modal facility and will provide the necessary room for the eventual construction of a loading platform for light rail.  COTA is underwriting the entire cost of the improvement except for construction inspection, which constitutes the City's financial contribution to the project.  This legislation establishes an encumbrance against which the Transportation Division can invoice construction inspection charges that subsequently accrue as revenue into the Development Services Fund.
 
 Fiscal Impact:  This expense is specifically budgeted within the 1995, 1999 Voted Streets and Highways Fund.   Emergency action is requested to satisfy this expense as soon as possible in order to maintain accurate cost accounting and provide for timely cash flow.

Body
 
WHEREAS, the City of Columbus has agreed to cooperate with the Central Ohio Transit Authority (COTA) in the construction of the Front Street Abutment Relocation improvement, and
 
WHEREAS, the City's financial contribution to this project is the cost of the construction inspection work performed up to and including $105,000.00, and
 
WHEREAS, an emergency exists in the usual daily operation of the Transportation Division, Public Service Department, in that an encumbrance must be established from which said construction inspection charges can be paid, thereby preserving the public health, peace, property, safety and welfare, now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.   That the Public Service Director be and hereby is authorized to establish an encumbrance for $105,000.00 from which construction inspection charges for the Transportation Division resulting from construction of the Central Ohio Transit Authority's Front Street Abutment Relocation improvement project can be paid.
 
SECTION 2.  That payment of said construction inspection charges constitutes the City's financial contribution to this project.
 
SECTION 3.  That the expenditure of $105,000.00, or so much thereof as may be needed, be and hereby is authorized from the 1995, 1999 Voted Streets and Highways Fund, Fund 704, Department 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6631, OCA Code 590436 and Project 590436 for this purpose.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
