Explanation
This legislation authorizes the Director of Public Utilities to enter into contract with TFH-EB, Inc. dba The Waterworks for the Project Dry Basement: Backwater Valve Installation and Sump Pump program for the Division of Sewerage and Drainage. The goal of this project is designed to prevent sewer backups in single and two-family homes in Columbus due to surcharging in city sewers from heavy rain or sewer blockages by protecting the home up to the top of casting of the nearest upstream manhole with a Spears or preapproved backwater valve, which allow use of plumbing fixtures above that elevation in the remainder of the home. Only homes deemed eligible by the City of Columbus, Department of Public Utilities, Division of Sewerage and Drainage qualify for this project. Under this project an eligible home with an interior perimeter foundation drain connection to the lateral is also eligible, at the owner’s option for the installation of a sump pump that will redirect the foundation drainage away from the sanitary lateral to the sump pump and then discharge that drainage away from the house. This contract is estimated to last 3 years. It is estimated that 120 valves (40/per year) and 60 sump pumps (20/per year) will be installed.
The Department of Public Utilities advertised for competitive bids for the subject project on the City’s Vendor Services website and in the City Bulletin in accordance with the relevant provisions of Chapter 329 of City Code relating to construction contracts. The Division of Sewerage and Drainage received three (3) bids on May 31, 2017 from the following companies:

These bids were reviewed and ranked utilizing the Bid Tab and Quality Factor Form process. It was determined that TFH-EB II, dba The Waterworks was the lowest responsive, responsible, and best bid.
This contract covers a three year period from the date of execution. The maximum obligation of the City, for parts and services described in this agreement is limited to $476,886.00. This total amount includes a 10% for Force Account work in the amount of $43,626.00. If unforeseen issues or difficulties are encountered that would require additional funding, a modification would be required.
This ordinance is being processed to transfer budget authority from Object Class 01-Personal Services to Object Class 02-Material and Supplies and Object Class 03-Service in order to align the budgeted funds with the projected needs for this contract.

To authorize the City Auditor to transfer $479,886.00 between Object Classes within the 2017 Sewerage System Operating Fund Budget; to authorize the Director of Public Utilities to enter into contract with TFH-EB, Inc., dba The Waterworks, for the Project Dry Basement: Backwater Valve Installation and Sump Pump program for the Division of Sewerage and Drainage; to authorize the expenditure of $479,886.00 from the Sewerage System Operating Fund; and to declare an emergency. WHEREAS, the Division of Sewerage and Drainage has a need to transfer $479,886.00 between Object Classes in the 2017 Sewerage System Operating Fund Budget. Funds were not budgeted for this contract as they were projected to be spent from the CIB; and
WHEREAS, the Department of Public Utilities, Division of Sewerage and Drainage wishes to enter into contract with TFH-EB, Inc., dba The Waterworks, for the purpose of providing for the Project Dry Basement: Backwater Valve Installation and Sump Pump program for the Division of Sewerage and Drainage; and
WHEREAS, this project is designed to prevent sewer backups in single and two-family homes in Columbus due to surcharging in city sewers from heavy rain or sewer blockages by protecting the home up to the top of casting of the nearest upstream manhole with a Spears or preapproved backwater valve, which allow use of plumbing fixtures above that elevation in the remainder of the home. Only homes deemed eligible by the City of Columbus, Department of Public Utilities, Division of Sewerage and Drainage qualify for this project; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to enter into contract with TFH-EB, Inc., dba The Waterworks, for the Project Dry Basement: Backwater Valve Installation and Sump Pump program for the Division of Sewerage and Drainage in order to comply with project requirements, for the preservation of the public health, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the transfer of $479,886.00 or so much thereof as may be needed, is hereby authorized between Object Classes within Fund 6100 Sewer System Operating Fund per the accounting codes in the attachment to the Ordinance.
SECTION 2. That the Director of Public Utilities be and is hereby authorized to enter into contract with TFH-EB, Inc., dba The Waterworks, 1999 Longwood Avenue, Grove City, Ohio 43123, for the Project Dry Basement: Backwater Valve Installation and Sump Pump program, in accordance with the terms and conditions as shown in the agreement on file in the office of the Division of Sewerage and Drainage.
SECTION 3. That the expenditure of $479,886.00 or so much thereof as may be needed, is hereby authorized in Fund 6100 Sewer System Operating Fund, in object class 02-Material and Supplies in the amount of $147,246.00, and in object class 03-Service in the amount of $332,640.00, per the accounting codes in the attachment to this ordinance.
SECTION 4. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.
SECTION 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes the same.
