Explanation
Background: This legislation authorizes a modification to the design contract with EMH&T, Inc. for the Roadways General Engineering-2003 project. The projects selected for design services are Victorian Village Traffic Circles Drainage and Roadway Improvements located on the Victorian Village Traffic Circles area between King Avenue to the North and Fifth Avenue to the South, Battelle Boulevard to the West and Neil Avenue to the East; and Richards Road Reconstruction and Improvements located on Richards Road between High Street to the West and Indianola Avenue to the East. The purpose of these projects are to provide new roadway surfacing, new curbs, sidewalks, and storm drainage. Subject to final design, the roadways may be completely rehabilitated where warranted. Construction is estimated to begin in April, 2008 and end December, 2008. A professional services contract for engineering is needed to assure timely completion of the design and as the Transportation Division does not maintain adequate staff or all of the various disciplines necessary to complete such design in house.
The contract modification is necessary for the final design work for these two projects. This modification is an addition to the original scope of services but is a continuation of the existing work having been performed and it would not be practical, economical, nor expedient to contract with a different consultant.
Current hourly rate, the overhead rate and the percentage of profit that were negotiated at the beginning of this project were used to determine the amount of this modification. EMH&T, Inc., CC # 310685594 expiring , was selected in 2003 in accordance with Chapter 329 for professional service contracts.
The original contract amount was $250,000.00. The amount of this modification is $175,000.00. The total of all modifications is $175,000.00. The contract amount, including all modifications is $425,000.000.
Emergency action is requested for immediate modification of the design contract for the earliest possible completion of the design and to schedule for construction and preserve the safety and welfare of the public.
Fiscal Impact: Funds in the amount of $175,000.00 are budgeted and available from the 1995, 1999, 2004 Voted Street and Highway Funds for the Transportation Division.

WHEREAS, contract no. EL 004296 was authorized by ordinance number 0634-2004, passed April 26, 2004, executed and approved by the City Attorney on June 3, 2004; and
WHEREAS, it is necessary to modify this contract to increase the Scope of Services as per the consultant's letter dated April 12, 2007, for the Victorian Village Traffic Circles Drainage and Roadway Improvement project; and consultant's letter dated April 12, 2007, for the Richards Road Roadway Improvements; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Transportation Division, in that the contract should be modified and increased immediately so that the work may proceed without delay, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Public Service be and is hereby authorized to modify and increase contract number EL004296, with EMH&T, Inc., to complete the design, construction plans, and permits for the projects, Victorian Village Traffic Circles Drainage and Roadway Improvements, and for the Richards Road Roadway Improvements in accordance with the plans on file in the office of the Public Service Director.
SECTION 2. That for the purpose of paying the cost thereof, the sum of $175,000.00 or so much thereof as may be needed, is hereby authorized to be expended from Fund 704, the 1995, 1999, 2004 Voted Streets and Highways Fund Transportation Division, Department No. 59-09, Object Level One Code 06, Object Level Three Code 6631, OCA Code 644385 and Project 530161.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
