Explanation
BACKGROUND: The Division of Water, Department of Public Utilities entered into a contract with CDM, for professional engineering services for the design of the Upgrade of Water Distribution System Control Data Acquisition project, on July 23,, 2001 under the authority of Ordinance No. 710-01 passed May 7, 2001. This modification provides for additional engineering services for construction management and inspection services for this project. The construction phase of the contract has taken longer than originally planned, and therefore additional inspection costs will be incurred. These additional fees will be reimbursed to the Division of Water by Televent Automation, the construction contractor, in the form of price rebates. CDM is a majority firm.

EXPLANATION:
1. Amount of additional funds to be expended under this modification: $42,000.00
2. Reasons additional goods/services could not be foreseen initially: This contract modification is for additional engineering services to continue inspection services past the expected completion date.
3. Reasons other procurement processes are not used: The existing consultant is uniquely familiar with the project.
- How cost of Modification was determined: The rates were negotiated between the Consultant and the City of Columbus as documented by the Consultant's quotation letter.

The original contract provided for engineering services for the design and construction management and inspection services for the Upgrade of Water Distribution System Control Data Acquisition project.
This Modification provides for additional engineering services to continue inspection services past the expected completion date.
FISCAL IMPACT: Monies are being transferred to fund this project and the 2004 C.I.B. is being amended to provide the necessary authority.

To authorize the Director of Public Utilities to modify the contract with CDM for construction management and inspection services for the Upgrade of Water Distribution System Control Data Acquisition project for the Division of Water, to amend the 2004 C.I.B., to authorize the City Auditor to transfer funds within the Water Works Enlargement Voted 1991 Bonds Fund and to authorize the expenditure of $42,000.00 from the Water Works Enlargement Voted 1991 Bonds Fund, ($42,000.00)

WHEREAS, Contract No. EA025131-002 was authorized by Ordinance No. 710-01, passed May 7, 2001, was executed on July 23, 2001, and
WHEREAS, the Division of Water wishes to expand the contract to include additional engineering services for construction management and inspection services for this project. The construction phase of the contract has taken longer than originally planned, and therefore additional inspection costs will be incurred, and
WHEREAS, it is necessary to modify Contract No. EA025131-002 to provide for these services, and
WHEREAS, it is necessary to authorize the Director of Public Utilities to modify Contract No. EA025131-002 for construction management and inspection services for the Upgrade of Water Distribution System Control Data Acquisition project for the preservation of public health, peace, property, safety and welfare; Now, Therefore;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be and is hereby authorized to modify Contract No. EA025131-002 with CDM, 8800 Lyra Drive, Columbus, Ohio 43240, for engineering services to provide for construction management and inspection services for the Upgrade of Water Distribution System Control Data Acquisition project in accordance with the terms and conditions as shown on the modification.
Section 2. That the expenditure of $42,000.00 or as much thereof as may be needed be and the same is authorized from the Water Works Enlargement Voted 1991 Bonds Fund No. 606, Department 60, Division 09, OCA Code 690466, Object Level Three 6621, Object Level One 06, Project Number 690466.
Section 3. That any modification made under the provisions of this ordinance must first be authorized by the Director of Public Utilities and a contract modification properly submitted to the City Auditor for certification of funds.
Section 4. That the City Auditor is hereby authorized and directed to transfer funds within the Water Works Enlargement Voted 1991 Bonds Fund, Fund No. 606, Department of Public Utilities, Division of Water, as follows:
