Explanation
BACKGROUND: This legislation authorizes the Finance and Management Director to renew an existing Universal Term Contract (UTC) for the option to obtain Flygt Pump Parts and Services with Xylem Water Solutions USA, Inc. This contract provides for Flygt Pump and Mixer Parts that are used for maintenance and repair of Flygt systems managed by the wastewater treatment plants and wastewater systems managed by the Division of Sewerage and Drainage.
The contract, PO087573 was established in accordance with Request for Quotation RFQ006459 and authorized under Ordinance Number 2612-2017 and will expire November 30, 2019. In accordance with the bid specifications, the City and Xylem Water Solutions USA Inc. can renew the contract for an additional one year term subject to mutual agreement and approval of proper City Authorities. The new contract expiration date will be November 30, 2020.
EMERGENCY DESIGNATION: The Finance and Management Department respectfully requests this legislation be considered an emergency measure to insure there is no interruption of goods/services provided.
FISCAL IMPACT: No funding is required to renew the option contract. The Department of Public Utilities must set aside their own funding for their estimated expenditures.

To authorize the Finance and Management Director to renew a Universal Term Contract for the option to purchase Flygt Pump Parts and Services with Xylem Water Solutions USA, Inc., and to declare an emergency.
Body
WHEREAS, the Purchasing Office entered into a Universal Term Contract for Flygt Pump Parts and Services for use by the Division of Sewerage and Drainage; and
WHEREAS, this contract was entered into in accordance with Chapter 329 of the Columbus City Code, pursuant to solicitation RFQ006459 with Xylem Water Solutions USA, Inc. deemed the lowest, most responsive, responsible and best bidder and
WHEREAS, in accordance with the bid specifications, the City and Xylem Water Solutions USA, Inc. can renew the contract for an additional one year period, subject to mutual agreement and approval of proper City authorities; and,
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities in that it is necessary to authorize the Finance and Management Director to immediately renew a Universal Term Contract with Xylem Water Solutions USA, Inc. for the option to obtain Flygt Pump Parts and Servicesto insure there is no interruption of goods/services provided, thereby preserving the public health, peace, property, safety, and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to renew the option contract with Xylem Water Solutions USA, Inc., PO087573 for a period of one year, from November 30, 2019 to and including November 30, 2020.
SECTION 2. That this extension is in accordance with relevant provisions of Chapter 329 of the Columbus City Code.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
