..Explanation
 
The last several years have witnessed the reconstruction of several portions of Cleveland Avenue.  The City undertook two projects, Cleveland Avenue north and Cleveland Avenue south, and Franklin County earlier rebuilt a portion of Cleveland Avenue (from Ferris Road to Morse Road) that resides primarily in the county but is surrounded by Columbus.  The City of Columbus, Transportation Division, has agreed to participate financially in the Franklin County Engineer's improvement of another similar section of Cleveland Avenue from Oakland Park Avenue to Ferris Road.  Improvements include full-depth pavement reconstruction, storm drainage and sidewalks with Americans with Disabilities Act-compliant wheelchair ramps.  Columbus' share of this project is estimated to total $800,000.00 and the county will bill the city a maximum of this amount based on their actual costs.  This ordinance provides for the reimbursement of $800,000.00 or so much thereof as may be necessary to the Franklin County Engineering Department for this purpose.
 
Fiscal Impact:  The Transportation Division 2004 Capital Improvements Budget contains $3 million for Arterial Street Rehabilitation.  The Transportation Division budgeted $800,000 for reimbursement to the Franklin County Engineering Department for the Cleveland Avenue project.  This ordinance authorizes $800,000 within the project Arterial Street Rehabilitation in Fund 704, the 1995, 1999 Voted Streets and Highways Fund.
 
Emergency action is requested so that the project may proceed on-schedule and the City can make payment to Franklin County in a timely manner.

Body
 
WHEREAS, the City of Columbus has agreed to participate financially in the Franklin County Engineering Department's Cleveland Avenue - Oakland Park Avenue to Ferris Road improvement project; and
 
WHEREAS, Columbus' share of this project is estimated to total $800,000.00 and the county will bill the city a maximum of this amount based on their actual costs; and
 
WHEREAS, funds for this improvement are available and budgeted within the Arterial Street Rehabilitation project in the 1995, 1999 Voted Streets and Highways Fund; and
 
WHEREAS, an emergency exists in the usual daily operation of the Transportation Division, Public Service Department, in that it is immediately necessary to satisfy this liability so the project may proceed in a timely manner, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to reimburse the Franklin County Engineering Department $800,000.00 or so much thereof as may be necessary for the city's share of costs incurred on the Cleveland Avenue - Oakland Park Avenue to Ferris Road improvement project for the Transportation Division.
 
SECTION 2.  That the expenditure of $800,000.00, or so much thereof as may be necessary, be and hereby is authorized from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6631, OCA Code 644385 and Project 530103.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
