Explanation
The Transportation Division is responsible for maintaining the City's pavement marking system.  A raised pavement marker project is needed to install reflective raised pavement markers on various roadways throughout the City. Every year, the Transportation Division prepares plans to install raised pavement markers on selected roadways as part of our pavement marking program.  These markers are a highly effective treatment to help enhance the visibility of pavement markings during nighttime and bad weather conditions. This project has been prepared with two parts: Part 1 includes installation of markers on twelve pre-determined roadways and Part 2 consists of an "on-call" service for the installation of markers and retro-reflective lens replacement. The locations and estimated quantities associated with Part 2 will be provided to the Contractor at a later time in the form of "work orders".  
 
This legislation authorizes the City to enter into a contract in the amount up to $229,230.00 for the Raised Pavement Markers - 2008 project and pay construction inspection costs up to $20,631.00. The estimated Notice to Proceed date is May 2008 with a contract duration of 365 days. This project was let by the Transportation Division and advertised in the Columbus City Bulletin. Formal competitive bids were received and tabulated on April 3, 2008 by the Transportation Division as follows:

The Transportation Division recommends the bid be awarded to, International Contractors Corporation, the lowest, best, most responsive and most responsible bidder, contract compliance number 52-2238691 (expires April 4, 2010).
 
The bid proposal stated that the bid quantities were estimated and that the bid quantities may be increased or decreased, depending on the funds available. Due to the better-than-expected unit prices in the submitted bids, an increased amount of raised pavement marker installation and retro reflective reflector replacement work can be completed without exceeding the budget of $250,000.00. This increase in bid quantities and amount of raised pavement marker work also includes estimated quantities associated with Part 2 of this contract. Contract quantities were increased, without changing the ranking of the bids received.
 
The low bidder, International Contractors Corporation has agreed to the revised quantities at the previously bid unit costs. Award is to be made to International Contractors Corporation for $229,230.00.
 
Fiscal Impact:  Funding in the amount of $249,861.00 is budgeted and available from the 2007 bond sale within the Voted 1995, 1999, 2004 Streets and Highways Fund for the installation of raised pavement markers.  This ordinance authorizes the expenditure of $249,861.00 for the installation and inspection of the Raised Pavement Markers - 2008 project.
 
Emergency action is requested to allow this project to begin in the spring of 2008 and complete Part 1 this construction season.

Body
WHEREAS, the Transportation Division is responsible for maintaining the City's pavement marking system; and
 
WHEREAS, raised pavement markers are a highly effective treatment to help enhance the visibility of pavement markings during nighttime and bad weather conditions; and
 
WHEREAS, formal competitive bids were received and tabulated on April 3, 2008 by the Transportation Division for the Raised Pavement Markers - 2008 project, and a satisfactory low bid was received; and
 
WHEREAS, funds are budgeted and available for this expenditure; and
 
WHEREAS, the Transportation Division recommends acceptance of the lowest and most responsive and responsible bid submitted by International Contractors Corporation, and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Transportation Division, in that it is immediately necessary to enter into contract for the installation of raised pavement markers with International Contractors Corporation to allow this project to begin in the spring of 2008 and complete Part 1 this construction season, thereby preserving the public health, peace and safety; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to enter into a contract with International Contractors Corporation, 450 East Starr Avenue Columbus, Ohio 43201 for the Raised Pavement Markers - 2008 project in an amount not to exceed $229,230.00 in accordance with the applicable specifications and plans on file in the office of the Transportation Administrator, which are hereby approved, and to provide for construction inspection services in the amount of $20,631.00.
 
SECTION 2.  That for the purpose of paying the cost of the contract and inspection, the sum of $249,861.00, or so much thereof as may be needed, be and hereby is authorized to be expended from Fund 704, the Voted 1995, 1999, 2004 Streets and Highways Fund, Department No. 59-09, Transportation Division, O.L. 01/03 Codes 06/6621, OCA Code 644385 and Project 540011 (Raised Pavement Markers).
 
SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
