Explanation
Background: This legislation authorizes a modification to the design contract with ms consultants, inc. for Phase II of the Sancus Boulevard Improvement project. The project is located on Sancus Boulevard between Worthington Woods Boulevard to the south and Lazelle Road to the north and is anticipated to start construction in 2010. The purpose of the project is to widen Sancus Boulevard to five lanes and install new curbs and gutters, as well as new sidewalks, bikelanes, street lighting, storm drainage and street trees. A professional services contract for engineering was needed to assure timely completion of the design and as the Transportation Division does not maintain adequate staff or all of the various disciplines necessary to complete such design in house.
The contract modification is necessary to compensate the vendor for updated design work. Construction of Phase I of the overall project to widen Sancus Boulevard (from Polaris Parkway south to Lazelle Road) was completed in 2002, but the design of Phase II was suspended in the same year because of fiscal constraints. The existing contract includes the design of Phases I and II. It also included the design of a partial widening of South Old State Road, construction of which was completed in 2001. Phase II was in the late stages of design when suspended and resumption of the design for Sancus Boulevard, Phase II requires extensive re-design to conform to present standards for ADA requirements, storm drainage, and newer specifications in general.
This modification is an addition to the original scope of services but is a continuation of the existing work being performed and it would not be practical to contract with a different consultant.
Current hourly rate, the overhead rate and the percentage of profit that were negotiated at the beginning of this project were used to determine the amount of this modification. ms consultants, inc., CC #34-6546916 Expires 7/29/08, was selected in 1997 in accordance with Chapter 329 for professional service contracts.
The original contract amount was $631,942.00. The amount of this modification is $269,156.00. The total of all modifications is $750,636.25. The contract amount, including all modifications is $1,382,578.25.
Emergency action is requested for immediate modification of the design contract for the earliest possible completion of the design to stay on schedule for construction and preserve the safety and welfare of the public.
Fiscal Impact: This ordinance authorizes the expenditure of $269,156.00 or so much thereof. Funding for this project is budgeted and available within the 1995, 1999, 2004 Voted Streets and Highways Fund for this work.

To authorize the Director of Public Service to modify and increase the contract with ms consultants in the amount of $269,156.00 for Phase II of the Sancus Boulevard Improvement project; to authorize the expenditure of $269,156.00 from the 1995, 1999, 2004 Voted Streets and Highways Fund; and to declare an emergency ($269,156.00).

WHEREAS, contract no. EA029479 was authorized by ordinance no. 404-97, passed February 24,1997, executed and approved by the City Attorney on April 7, 1997; and
WHEREAS: it is necessary to modify this contract to increase the Scope of Services as per the consultant's letter dated March 13, 2007 for the Sancus Boulevard Improvement, Phase II project; and
WHEREAS: an emergency exists in the usual daily operation of the Department of Public Service, Transportation Division, in that the contract should be modified and increased immediately so that the work may proceed without delay, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
Section 2. That the Director of Public Service be and is hereby authorized to modify and increase contract no. EA029479, with ms consultants, inc., 333 Federal Street, Youngstown, OH 44503, to complete the design, construction plans, and permits for the Sancus Boulevard Improvement, Phase II project in accordance with the plans on file in the office of the Public Service Director.
Section 3. That for the purpose of paying the cost thereof, the sum of $269,156.00 or so much thereof as may be needed, is hereby authorized to be expended from fund 704, the 1995, 1999, 2004 Voted Streets and Highways Fund, Dept/Div. 59-09, OCA code 644385, Object Level One Code 06, Object Level Three Code 6682, Project 530103, Arterial Street Rehabilitation.
Section 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
