REZONING:  Z02-110
 
APPLICANT:  Deltar, Inc.; c/o Donald T. Plank, Atty.; 145 East Rich Street; Columbus, Ohio 43215.
 
PROPOSED USE:  Single-family residential development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-0) on March 13, 2003.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The applicant requests the PUD-6, Planned Unit Development District to develop the site with 53 single-family dwellings.  The proposed net density of 4.86 units per acre and development standards are virtually identical to the PUD-6 rezoning approved in December, 2002 (Z02-045) that allows 142 single-family dwellings to be developed on approximately 29 acres located to the immediate west.  The current development will be integrated into the adjacent site zoned for PUD-6 single- family residential development with two public streets to be platted as part of the Z02-045 PUD-6 site plan.

WHEREAS, application #Z02-110 is on file with the Building Services Division of the Department of Development requesting rezoning of 10.98± acres from R, Rural District to PUD-6, Planned Unit Development District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, , the City Departments recommend approval of said zoning change noting that the applicant requests the PUD-6, Planned Unit Development District to develop the site with 53 single-family dwellings and that the proposed net density of 4.86 units per acre and development standards are virtually identical to the PUD-6 rezoning approved in December, 2002 (Z02-045) that allows 142 single-family dwellings to be developed on approximately 29 acres located to the immediate west.  The current development will be integrated into the adjacent site zoned for PUD-6 single- family residential development with two public streets to be platted as part of the Z02-045 PUD-6 site plan, now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

Situate in the State of Ohio, County of Franklin, Township of Hamilton, being in the Northeast Quarter of Section 28, Township 4 North, Range 22 West, Congress Lands, and being all of the remainder of an original 10.002 acre tract conveyed to Dan Rohrbaugh and Theresa M. Rohrbaugh, by deed of record in Instrument number 199903150063101, also being all of a 1.332 acre tract conveyed to Danny M. Rohrbaugh and Theresa M. Rohrbaugh, by deed of record in Instrument Number 20011220029641, records of the Recorder's Office, Franklin County, Ohio, and being more particularly described as follows:
 
BEGIN FOR REFERENCE, at a Franklin County Engineers monument found (referenced as FCE 5557) at the intersection of the centerline of Rathmell Road and the centerline of Parsons Avenue;
 
Thence North 86° 23° 08° West, a distance of 581.07 feet, along the centerline of said Rathmell Road, to a point, at the northeasterly corner of a 0.340 acre tract conveyed to the Franklin County Commissioners by deed of record in Instrument Number 2000207030164790;
 
Thence South 0° 15° 36° West, a distance of 40.00 feet, along the easterly line of said 0.340 acre tract, to a point, at the common corner of said 0.340 acre tract the remainder of said original 10.002 acre tract, and in the southerly right-of-way of said Rathmell Road, said point also being at the POINT OF TRUE BEGINNING;
 
Thence South 04° 15° 36° West, a distance of 1288.64 feet, along the line common to the remainder of said original 10.002 acre, said 1.332 acre tract, a 2.5045 acre tract conveyed to David Stewart and Shari Lynn Stewart, by deed of record in Instrument Number 200107190164638, and a 6.667 acre tract conveyed to Columbus & Southern Ohio Electric Company, by deed of record in Deed Book 2786, Page 558, to a point in a northerly line of a 496.37 acre tract conveyed to Tarmack Enterprises II, L.P., by deed of record in Instrument Number 200108080182912;

Section 2.  That a Height District of Thirty-five (35) feet is hereby established on the PUD-6, Planned Unit Development District on this property.
 
 
Section 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved PUD-6, Planned Unit Development District and Application among the records of the Building Services Division as required by Section 3311.09 of the Columbus City Codes; said plan being titled "Hartman Ponds East PUD Plan" by Donald Plank, Attorney for the Applicant, and dated April 8, 2003. June 27, 2003.
 
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
