Explanation
 
Background:
This ordinance will authorize the Director of Recreation and Parks to enter into a contract with MS Consultants for Bikeway engineering services, SR 161 along the east side of Big Walnut Creek.
 
The work includes: site survey, hydraulic analysis of big walnut creek, environmental permitting, preliminary structural analysis, preliminary alignment, construction documents, and provide a cost estimate.
 
ODOT has granted preliminary approval for the engineering of a trail underpass beneath SR 161, at the bridge over Big Walnut Creek.  The limits of this project run from a public street to the south, to the LA right of way limit on the north, approx. 1200 L.F.  No additional right of way is required.
 
The project requires full ODOT review and access permit.  ODOT is willing to include construction of the project with the current NEXT/161 construction project, providing plans are completed by July of 2007.  Due to the tight schedule, ODOT has met with CRPD and MS Consultants, civil engineers for the 161 highway project, to develop a scope that meets ODOT's construction schedule and design requirements.

The department is requesting the waiver of the formal bidding provisions of the Columbus City Codes to enter into a contract with MS consultants.  By using the engineering services of MS Consultants, the project can:
-Meet the short time constraints required by ODOT;
-The City will save construction funds by building the bikeway underpass during ODOT highway construction, minimizing access and permitting issues;
-Use existing design information, including design storm elevations, from the highway bridge project, thus reducing engineering overhead;
-The consultant provides seamless continuity with ODOT District staff and field construction staff.
 
Emergency action is necessary to meet the ODOT time schedule for construction.
 
Fiscal Impact:
$68,519.11.00 is required and budgeted in the Voted 1999/2004 Parks and Recreation Bond Fund to meet the financial obligation of this contract.
 
 
Title
 
To authorize and direct the Director of Recreation and Parks to enter into a contract with MS Consultants for bikeway engineering, to waive the necessary competitive bidding requirements, to authorize the expenditure of $68,519.11 from the Voted 1999/2004 Parks and Recreation Bond Fund, and to declare an emergency.  ($68,519.11)
 
Body
 
      WHEREAS, it is in the best interest of the City of Columbus to waive the requirements of competitive bidding and contract with MS Consultants the Bikeway Engineering project; and
 
       WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into contract  to meet the construction schedule of ODOT.
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
               Section 1.   That this Council finds it in the best interest of the City of Columbus to waive requirements of competitive bidding for services for the bikeway engineering project, and does hereby waive provisions of Section 329.12 of the Columbus City Codes.
 
              Section 2.   That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with MS Consultants for the bikeway engineering project.
 
               Section 3.   That the expenditure of $68,519.11, or so much thereof as may be necessary, be and is hereby authorized from the Recreation and Parks Voted 1999/2004 Bond Fund No.702, Dept. 51-01, Project #510316, OCA Code 644526, and Object Level 3 No. 6680, to pay the cost thereof.
 
            Section 4.   That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
 
      Section 5.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
