Title: To authorize the Director of Finance and Management to request proposals and offers for the purchase of that 90.49 acre site located on Little Walnut Road (Rader Farm), and that 116.92 acre site located on Duval Road (Edgar Farm) located in Pickaway County; to waive the land review commission requirements of Columbus City Codes; and to declare an emergency.
Explanation
 
The City currently owns certain real property located in Pickaway County described as: 90.49 acre site located on  Little Walnut Road (Rader Farm), Pickaway County Parcel M3000040006600, acquired by the City of Columbus in 1995; and a 116.92 acre site located on Duval Road (Edgar Farm), Pickaway County Parcels F1600010002000, F1600010002001, and F1600010010200, acquired by the City of Columbus in 1992.  Both sites were purchased for use in the South Wellfield Expansion Project as authorized by Ordinance #1963-77, passed by Columbus City Council in October, 1977.  
 
After the purchase of the properties, Public Utilities conducted in-depth studies of the water table at each site. The studies determined that the water table on these properties is not suitable for use in the South Wellfield Expansion Project.  After review, a use of the properties for City operations could not be identified, therefore, both sites have been deemed to be surplus property. The Director of the Department of Finance and Management requests authority to determine the current marketability of these properties by soliciting proposals and purchase offers, by both public notice and real estate industry notice, for the sale of the properties and to entertain discussions and negotiations with interested parties with respect to sale of each property.
 
This ordinance authorizes the Director of the Department of Finance and Management to advertise the two (2) properties, solicit purchase proposals, respond to and negotiate with interested parties, and waive the land review commission requirements of Chapter 328 and Chapter 329 of the Columbus City Codes (1959) Revised.
 
Any agreement for the sale of the properties shall require approval by subsequent Council ordinance.

Emergency Justification: Emergency action is requested to enable the City to immediately begin the disposal process of these assets which are no longer required by the City and to eliminate their associated maintenance costs.

Body
 
WHEREAS,  the City of Columbus owns that real property located in Pickaway County identified as a 90.49 acre site located on Little Walnut Road (Rader Farm) and that 116.92 acre site located onDuval Road (Edgar Farm) that have been deemed to be surplus properties with no forecasted use in City operations; and
 
WHEREAS,   the Department of Finance and Management requests authority to determine the current marketability of these properties and to entertain discussion from and enter into negotiations with interested parties with respect to the sale of these two (2) properties in order to assess the course of action that will be in the best interest of the City; and
 
WHEREAS, any agreement for the sale of either of the two properties shall require approval by Council ordinance; and
 
WHEREAS, an emergency exists in the usual daily operation of the City, in that it is necessary to immediately authorize the Director of the Department of Finance and Management to determine the current marketability of these two properties, and for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of the Department of Finance and Management be authorized to solicit purchase proposals and enter into negotiations regarding the potential sale of that 90.49 acre City-owned real property on  Little Walnut Road (Rader Farm), Pickaway County Parcel M3000040006600 and that 116.92 acre City-owned real property on Duval Road (Edgar Farm), Pickaway County Parcels F1600010002000, F1600010002001, and F1600010010200.
 
Section 2. That this Council has determined that it is in the best interest of the City of Columbus to waive and does hereby waive the requirements of Columbus City Codes (1959) Revised, Chapter 328 (land review commission) and that portion of Chapter 329 that pertains to land review commission requirements.
 
Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
