Explanation
 
BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a contract for the installation of street lighting systems in the Independence Village area under two different projects.  Property owners have submitted a petition for a high pressure sodium street lighting system with ornamental poles and underground wiring (Project I), except for two streets that have opted to have the standard street lighting system composed of wood poles and overhead wiring (Project II).
 
Streets under Project I include:  Bennell Drive from Gender Road to and including parcel number 530-217848, Ethan Drive from Centennial Drive to Breed Drive, Centennial Drive, Deepwood Drive, Breed Drive, Breed Court, Wembly Court, Deepwood Court, Blakely Court, Carlin Court, Islington Court, Dewbourne Drive, Earlington Lane, Overton Way, Gormsley Drive, Erindale Drive, Yorkdale Lane, Creighton Place, Stockton Lane, Metuchen Place, Tildon Lane, and Hubbardton Place.  
 
Project I will be funded through the assessment procedure, which will require a transfer of funds from the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund for the City's share in the cost of installing the street lighting system.
 
Streets under Project II include:  Alexdon Court and Canby Place.
 
Project II will be funded through the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund.
 
Resolution No. 157X-2004, adopted July 12, 2004, authorized the preparation of plans and specifications.  Emergency declaration of necessity, Resolution Number 0072X-2005 was adopted May 23, 2005.  Ordinance Number 0007-2006, determining to proceed, was passed January 23, 2006.
 
Three bids were received and opened by the Director of Public Utilities on March 8, 2006, against Solicitation No. SA001920.  The Division of Power and Water recommends an award to Complete General Construction Co., in the amount of $356,079.52, as the lowest, responsive, and responsible bid received.  Their Contract Compliance Number is 31-4366382.

Emergency action is requested due to citizens' approved petition for a timely implementation of construction services.
 
FISCAL IMPACT:  The determined amount to be paid for the City's share under the Independence Village Street Lighting Assessments Project (I) is $95,000.00.  This legislation is contingent upon the passage of Ordinance 0990-2006, which authorizes the issuance and sale of special assessment bond anticipation notes in the amount of $319,000.00.  There is sufficient funding in the Voted 1995 and 1999 Street Lighting and Electricity Distribution System Improvements Fund for Project II.

WHEREAS, Complete General Construction Co. submitted the lowest, responsive, and responsible bid opened by the Director of Public Utilities on March 8, 2006 for the installation of the aforesaid street lighting systems; and
 
WHEREAS, funding is necessary to pay for construction costs, design, construction inspection, engineering, advertising and printing, and any other miscellaneous expenses for said project; and
 
WHEREAS, it is necessary to transfer funds from the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund into the Street Lighting Assessment Fund to provide for the City's share in the cost of installing a street lighting system with underground wiring in the Independence Village Project I area under the assessment procedure; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Power and Water, in that it is immediately necessary to enter into a contract for labor and material for the construction of street lighting improvements in the Independence Village area, Projects I and II, in an emergency manner in order to complete financial transactions and enter into a contract to comply with citizens' approved petition for timely implementation of construction services, for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the City Auditor is hereby authorized and directed to transfer $95,000.00 from the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvement Fund 553 into the Street Lighting Assessment Fund 580, Division No. 60-07, for Project I, as follows:

SECTION 2.  That the City Auditor is hereby authorized to appropriate $95,000.00 in the Independence Village Street Lighting Assessments Project (I), Fund No. 580, Subfund 978, OCA 580978, Object Level Three 6625.
 
SECTION 3.  That the Director of Public Utilities is hereby authorized to enter into a contract with Complete General Construction Co., in the amount of $356,079.52, to install street lighting systems in the Independence Village area, and to obtain and pay for the services of the Division of Power and Water, the Transportation Division, and any services of other City Divisions as may be necessary up to a maximum amount of $77,247.98, for a grand legislative total of $433,327.50.
 
SECTION 4.  That to pay the cost of the aforesaid contract and expenses, the expenditure of $433,327.50, or so much thereof as may be needed, be and is hereby authorized from the Division of Power and Water, Division No. 60-07, as stated below:
