Explanation
1. BACKGROUND: This legislation authorizes the Director of Public Utilities to enter into an agreement with Metcalf & Eddy of Ohio, Inc., for professional engineering services for Scioto Main/West Side Relief Sewer Rehabilitation. This project will assess/clean/rehabilitate the Scioto Main and West Side Relief Sewer.
2. ENGINEERING CONTRACT AWARD: Metcalf & Eddy of Ohio, Inc., was selected in accordance with the procedures set forth in Columbus City Code, Section 329.13, "Awarding professional service contracts through requests for Statements of Qualifications". 18 statements of qualifications were received and opened on September 5, 2003. Requests for Cost Proposals (RFP's) were sent to three firms having the experience necessary to complete the project; MS Consultants, Inc., Brown and Caldwell, and Metcalf & Eddy of Ohio, Inc. All three consultants submitted RFP's on October 27, 2006.
Upon review of the technical proposals, the bidders were ranked using criteria specified in City Code, and more specifically: proposal quality/feasibility, competence to perform required work, project schedule, and location of the workforce.
Based upon these criteria, Metcalf & Eddy of Ohio, Inc., was selected as the highest-ranked bidder. Their Contract Compliance Number is 22-2581306.
3. FISCAL IMPACT: Sufficient funding for this project is already present but there will be a amendment to the 2006 Capital Improvements budget to provide sufficient budget authority.

To authorize the Director of Public Utilities to enter into an agreement for professional engineering services with Metcalf & Eddy of Ohio, Inc. for Scioto Main/West Side Relief Sewer Rehabilitation and to authorize the expenditure of $1,045,611.70, within the Sanitary Sewer Bond Fund; and to amend the 2006 Capital Improvements Budget, for the Division of Sewerage and Drainage ($1,045,611.70).

WHEREAS, Requests for Cost Proposals were received and opened on October 27, 2006 for engineering services for the Scioto Main/West Side Relief Sewer Rehabilitation project; and
WHEREAS, Metcalf & Eddy of Ohio, Inc., was selected based on the following criteria: proposal quality/feasibility, competence to perform required work, project schedule, and location of the workforce; and
WHEREAS, it is necessary to authorize the Director of Public Utilities to enter into an agreement for professional engineering services to assess/clean/rehabilitate the Scioto Main and West Side Relief Sewer; and
WHEREAS, it is necessary to authorize an amendment to the 2006 Capital Improvements Budget for purposes of providing sufficient budget authority for the project expenditure; and
WHEREAS, it has become necessary in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, to authorize the Director of Public Utilities to enter into an agreement for professional engineering services, for the Scioto Main/West Side Relief Sewer Rehabilitation, for the preservation of the public health, peace, property, and safety; now therefore.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 2. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 4. That the Director of Public Utilities be and hereby is authorized to execute an agreement with Metcalf & Eddy of Ohio, Inc, 2800 Corporate Exchange Drive, Suite 300, Columbus, OH 43231, for the Division of Sewerage and Drainage, for professional engineering services for Scioto Main/West Side Relief Sewer Rehabilitation in accordance with the terms and conditions on file in the office of the Division of Sewerage and Drainage.
SECTION 5. That the said engineering firm shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
SECTION 6. That for the purpose of paying the cost of the professional engineering services contract, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows: Division 60-05, Fund 664, Project 650696, Object Level One 06, Object Level Three 6621, OCA Code 650696, Amount $1,045,611.70.
SECTION 7. That the 2006 Capital Improvements Budget Ordinance No. 1108-2006 is hereby amended as follows to Fund 664, to provide sufficient budget authority for the execution of the engineering contract stated in Section 3 herein.

SECTION 8. That this ordinance shall take effect and be in force from and after the earliest date allowed by law.
