Explanation
The Public Service Department, Refuse Collection Division, has contracted (under several contracts) with Rumpke of Ohio, Incorporated, since September 1994 to provide weekly yard waste collection services to Columbus residents.  The current contract for yard waste collection with Rumpke commenced March 1, 2001 for a five-year period contingent upon annual funding approval from City Council.  This was initially authorized by Ordinance 0365-2001 (passed February 26, 2001); it authorized $2,654,646 to be expended from March 1, 2001 through February 28, 2002 (12 months' funding).  This contract has been modified and increased in subsequent years as follows:
 
·      Ordinance 0346-2002 (passed March 4, 2002) authorized $2,163,864 to be expended from March 1, 2002 through February 28, 2003 (12 months' funding)
·      Ordinance 0312-2003 (passed February 24, 2003) authorized $1,989,480 to be expended from March 1, 2003 through December 31, 2003 (10 months' funding)
·      Ordinance 0401-2004 (passed March 15, 2004) authorized $2,643,448 to be expended from January 1, 2004 through December 31, 2004 (12 months' funding)
·      Ordinance 0057-2005 (passed February 14, 2005) authorized $3,242,300 to be expended from January 1, 2005 through December 31, 2005 (12 months' funding)
 
The existing contract balance is $548,345.12.  It is estimated that $900,000.00 is needed to cover billings for December 2005 and January and February 2006.  The difference between these numbers is $351,654.88.
 
This ordinance authorizes the Public Service Director to modify and increase the existing yard waste collection contract with Rumpke of Ohio, Incorporated, for the period January 1 through February 28, 2006.
 
Rumpke's contract compliance number is 31-1617611; this expires April 18, 2008.
 
Fiscal Impact:  The Refuse Collection Division has allocated $3,925,906.00 in the pending 2006 General Fund budget for yard waste collection for the period January 1- December 31, 2006.  This ordinance will utilize up to $351,654.88 of this amount.  Subsequent to the contract's completion at the end of February, any existing balance on this contract will be cancelled and be available for use in the next contract.    
 
Emergency action is requested to replenish funding for this contract in a timely manner to avoid service interruptions to residents.  Consideration of this ordinance as a thirty-day measure is impractical given the timing of passage of the General Fund budget and the projected exhaustion of existing contract funding.  Also, this ordinance cannot be passed in advance of the 2006 budget as it is contingent upon the budget's passage.

Body
WHEREAS, there is a need for the Public Service Department, Refuse Collection Division, to continue to provide yard waste collection to residents; and
 
WHEREAS, the existing contract for yard waste collection with Rumpke of Ohio, Incorporated, commenced March 1, 2001, for a five-year period (conditional on funding availability); and
 
WHEREAS, it is in the City's best interest to modify and increase the current yard waste collection contract with Rumpke of Ohio, Incorporated; and
 
WHEREAS, an emergency exists in the usual daily operation of the Refuse Collection Division, Public Service Department, in that it is immediately necessary to modify and increase this contract in a timely manner to avoid service interruptions to residents, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.       That the Public Service Director be and hereby is authorized to modify and increase the existing contract with Rumpke of Ohio, Incorporated, for yard waste collection service for the Refuse Collection Division for the period January 1, 2006, through February 28, 2006, inclusive.
 
SECTION 2.       That the sum of $351,654.88, or so much thereof as may be necessary for this purpose, be and hereby is authorized to be expended from the General Fund, Fund 010, Department No. 59-02, Refuse Collection Division, Object Level One Code 03 and Object Level Three Code 3336 as follows:

SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
