Explanation
A revised grant award adjusting approved budget line items within the original grant amount and an extension until December 15, 2006 has been approved by the Franklin County Commissioners, Justice Programs Unit (JPU), for stalking investigative services. It is therefore necessary to transfer funds within the grant fund and to modify an agreement with E Investigations, Inc. to accommodate said revisions.
An original contract with Mark W. Ely was authorized by ordinance 0183-05 for a maximum amount of $53,450.00. Ordinance 1445-2005 assigned said contract to E Investigations, Inc. and modified the contract for an additional amount of $480.00 with a maximum amount of $53,930.00. A second modification of the contract for an additional $6,157.00 was authorized by ordinance 2019-05 with a maximum amount of $60,087.00.
This third contract modification will incorporate the revised grant award as approved by the JPU and increase the total contract amount by an additional $2,535.00 to a new total maximum of $62,622.00. The total grant will remain at $74,072.00.

To authorize the transfer of $2,153.58 within the Stalking Investigator Grant fund; to authorize the City Attorney to modify an agreement for stalking investigative services with E Investigations, Inc. for an additional $2,535.00; to authorize the expenditure of $2,535.00 from said fund; to waive the competitive bidding provisions of the Columbus City Codes; and, to declare an emergency. WHEREAS, a grant budget adjustment has been authorized by the Justice Programs Unit and therefore a transfer within the grant fund is necessary to align expenditures; and
WHEREAS, Ordinance 0183-05 authorized the City Attorney to enter into contract with Mark W. Ely nka E Investigations, Inc. for stalking investigative services in the amount of $53,450.00; and
WHEREAS, Ordinance 1445-05 authorized the assignment and first modification of the original contract in the amount of $480.00; and
WHEREAS, Ordinance 2019-05 authorized the second modification of the contract in the amount of $6,157.00; and
WHEREAS, it is necessary to further modify said contract in the amount of $2,535.00 in order to accommodate the grant budget adjustments authorized by the Justice Programs Unit; and
WHEREAS, it is in the best interests of the City to waive the provisions of Chapter 329 of the Columbus City Codes, 1959, relative to the procurement of professional services; and
WHEREAS, an emergency exists in the usual daily operation of the City Attorney's Office in that it is immediately necessary to authorize the transfer and expenditure of funds within the Stalking Investigator Grant funds and to authorize the modification of a contract with E Investigations, Inc. in order that the services supported may continue uninterrupted and for the preservation of the public health, peace, property, safety and welfare; now therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS, OHIO
Section 1. That the amount of Two Thousand One Hundred Fifty-three and 58/100 Dollars ($2,153.58) is hereby transferred within the Stalking Investigator Grant fund as follows:

Section 2. That the City Attorney be and hereby is authorized to modify a contract with E Investigations, Inc. for stalking investigative services in the amount of Two Thousand Five Hundred Thirty-five Dollars ($2,535.00) in order to continue said services in accordance with the adjusted Stalking Investigator Grant #2004-DG-B-D100.
Section 3. That for the reason stated in Section 2, the expenditure of Two Thousand Five Hundred Thirty-five Dollars ($2,535.00), or so much thereof as may be necessary, is hereby authorized as follows: department 2401, Stalking Investigator Grant, grant number 245004, fund number 220, oca 245004, object level 1 - 03.
Section 4. That the provisions of Chapter 329 of the Columbus City Codes, 1959, relative to the procurement of professional services are hereby waived.
Section 5. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes the same.
