Title: To authorize the Director of the Department of Development to execute any and all necessary agreements and deeds for conveyance of title for those properties identified as Tract 1 (20.098 acres) and the necessary portion of Tract 2 (2.410 acres); and to declare an emergency.
Explanation
 
BACKGROUND:      The City of Columbus, owner of the properties identified as Tract 1 (20.098 acres) Parcel Identification 010-267201 and Tract 2 (2.410 acres) Parcel Identification 010-267202 on the east side of North Wheatland Avenue, determined value of $450,000.00.  The City published and administered an RFQ/RFO process for a 22.5-acre urban infill development in the Greater Hilltop Neighborhood in which Dominion Homes, Incorporated was selected.  The City has received a request from Dominion Homes, Incorporated to purchase said properties. Dominion Homes, Incorporated proposes to construct 106 single-family homes for a new neighborhood on the east side of North Wheatland Avenue, to be called "Village at Wheatland Park."
 
FISCAL IMPACT: No funding is required for this legislation.
 
 
Title
 
To authorize the Director of the Department of Development to execute any and all necessary agreements and deeds for conveyance of title for those properties identified as Tract 1 (20.098 acres) and the necessary portion of Tract 2 (2.410 acres); and to declare an emergency.
 
 
Body
 
WHEREAS, the City of Columbus is the owner of those properties identified as Tract 1 (20.098 acres) and Tract 2 (2.410 acres); and
 
WHEREAS, the City of Columbus purchased these properties from the State of Ohio for $450,000; and
 
WHEREAS, Dominion Homes, Incorporated desires to purchase said properties for a value of $450,000.00 to build a new 106-unit single-family neighborhood; and
 
WHEREAS, The Greater Hilltop Commission has reviewed and approved this proposed development by a vote of 11-2; and
 
WHEREAS, Dominion Homes, Incorporated has agreed to demolish the remaining structure on the site at no cost to the City of Columbus; and
 
WHEREAS, Dominion Homes, Incorporated has agreed to dedicate approximately 5 acres of wooded land on the north side of Tract 1 to expand the existing Sullivant Trace Park; and
 
WHEREAS, in order to complete the transfer of such property/properties to the purchasers, authority is needed for the Director of Trade and Development to execute any and all necessary agreements and deeds of conveyance for such real property; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Development, Land Management Office, in that it is immediately necessary to execute any and all necessary agreements and deeds for conveyance of title for those properties identified as Tract 1 (20.098 acres) and the necessary portion of Tract 2 (2.410 acres), in order to preserve the public peace, health, safety, and welfare; and NOW, THEREFORE,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.      That the Director of the Department of Development be and is hereby authorized to execute deeds and other documents necessary to complete the transition necessary to transfer any portion of those properties identified as Tract 1 (20.098 acres) and Tract 2 (2.410 acres).
 
Section 2.      That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be in force and after its passage and approval, or ten days after passage if the Mayor neither approves nor vetoes the same.
