Explanation
1.  BACKGROUND
This legislation authorizes the Director of Public Service to enter into a contract for the Division of Design and Construction for a professional services engineering contract for the Arterial Street Rehabilitation - Hard Road Phase A/Sawmill Road - Smoky Row Road project with URS Corporation - Ohio for $1,201,162.02.  A professional services contract for engineering is needed to assure timely completion of the design and as the Division of Design and Construction does not maintain adequate staff or all of the various disciplines necessary to complete such design in house.
 
This project will be for the development of Ohio Department of Transportation contract construction plans for the widening of Hard Road from two lanes to five lanes.  The completed design will include sidewalks, provisions for bicycle traffic, curb, enclosed drainage, signals, street lighting, traffic control, and maintenance of traffic.  The length of the project is approximately 1.2 miles, from Sawmill Road to 387 feet west of Smoky Row Road. (FRA - CR61-1.10 (PID 17575) Hard Road Phase A)
 
The project was formally advertised on the City's Vendor Services web site and ODOT's web site from November 17, 2009, to December 29, 2009.  The city received eleven (11) responses.  All proposals were deemed minimally compliant and were fully evaluated when the Evaluation Committee met on January 15, 2010.                 
 
That Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against URS Corporation - Ohio.
 
2.  CONTRACT COMPLIANCE
URS Corporation - Ohio, contract compliance number is 340939859 and expires 8/28/11.
 
3.  EMERGENCY DESIGNATION
Emergency action is requested to keep on schedule for ODOT design funding and the overall design schedule to meet the ODOT funding deadlines for construction.
 
4.  FISCAL IMPACT
The City has received a reimbursement grant in the amount of up to $960,000.00 for the design of this project.  A City match in the amount of up to $241,162.02 will be required.  Monies are available within the Streets and Highways G.O. Bonds Fund, The Street and Highway Improvement Fund and The High Street/Goodale Street Cap Fund for the City match for this project.  They will be appropriated and transferred to the Fed-State Highway Engineering Fund and appropriated and expended within the Fed-State Highway Engineering Fund.

Body
WHEREAS, the Director of Public Service has identified the need to enter into a professional service engineering contract for the preparation of design plans for the Arterial Street Rehabilitation - Hard Road Phase A/Sawmill Road - Smoky Row Road project; and
 
WHEREAS, a satisfactory proposal has been submitted by URS Corporation - Ohio; and
 
WHEREAS, the Department of Public Service has been awarded a grant in the amount of up to $960,000.00 in ODOT funds for the design of project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction, in that this legislation should go forth immediately to maintain the overall design schedule in order to meet the Ohio Department of Transportation funding deadlines for construction, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of Public Service be and is hereby authorized to enter into a contract with URS Corporation - Ohio, Inc., 277 West Nationwide Boulevard, Columbus, OH 43215 in the amount of $1,201,162.02 or so much as needed for the design of the Arterial Street Rehabilitation - Hard Road Phase A/Sawmill Road - Smoky Row Road project.
 
Section 2.  That the 2010 Capital Improvement Budget authorized by ordinance 0564-2010 be and is hereby amended due to cancellations of encumbrances as follows:

Section 8.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 9.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.  That this ordinance shall take effect from and after the earliest period allowed by law.
