Explanation
BACKGROUND: This legislation authorizes the Director of Finance and Management to modify and increase the Office of Construction Management's professional service contract (authorized by Ordinance No. 2152-2005, passed 12/14/2005) with eS Architecture and Development, Inc. for the design, consulting, and construction administration services in order to produce a new police station, to be shared by the City of Columbus and The Ohio State University. The design services will include US Green Building Council LEED Certification. This is in compliance with the Mayor's policy directive "Get Green Columbus 2005: Environmental Stewardship in the 21st Century." eS Architecture and Design is responsible for producing a design of a facility to a LEED Certified level, progressive meetings with the City and the community through the completion of agreed upon final product, renderings, drawings, specifications, the bid process, and construction administration.
The contract modification is necessary as it will provide for the payment of additional services that exceeded the original base scope. The original construction budget was expanded from $2,450,000.00 to $3,200,000.00. In addition, this modification will provide for the inclusion of design and specifications of FFE in the bid documents.
Emergency action is requested to complete the project design work as soon as possible in order to maintain the identified construction schedule, thereby providing needed public safety services to The Ohio State University area as quickly as possible.

FISCAL IMPACT: The modification amount requested under this ordinance is $147,500.00. The amount of the original contract is $375,000.00 for a contract total, including this modification, of $522,500.00.

To authorize the Director of Finance and Management to modify and increase an existing professional services contract with the eS Architecture and Development, in connection with the new police facility to be shared by the City of Columbus and The Ohio State University, to authorize the additional expenditure of $147,500.00 from the Safety Voted Bond Fund, and to declare an emergency. ($147,500.00).
Body
WHEREAS, structural changes, an increase in the size of the facility, and requirements from various area commissions require modification of the scope of services contained within the contract; and
WHEREAS, it is necessary to modify and increase this contract in order to design and administer the construction of a new police facility to be shared by the City of Columbus and The Ohio State University; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Finance and Management, Office of Construction Management, in that it is immediately necessary to authorize the Director of Finance and Management to modify and increase the existing professional services contract with eS Architecture and Development, Inc.to complete the project design work as soon as possible in order to maintain the identified construction schedule, thereby providing needed public safety services to The Ohio State University area as quickly as possible; now , therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Finance and Management is hereby authorized to modify and increase a contract with eS Architecture and Development, Inc. for the design and construction administration of a new police facility to be shared by the City of Columbus and The Ohio State University.
SECTION 2. That the expenditure of $147,500.00, or so much thereof that may be necessary in regard to the action authorized in Section 1, is hereby authorized and approved as follows:

SECTION 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 4. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the mayor neither approves or vetoes the same.
