Explanation
 
The Transportation Division is responsible for maintaining the City's roadway system through a viable renovation program.  A brick rehabilitation project is needed to prevent premature deterioration of the City's brick roadways as well as emergency repairs.  This contract has been prepared with two parts: Part 1 consisting of pre-selected streets requiring brick rehabilitation; and, Part 2 consisting of an "on-call" service for emergency and non-emergency brick repairs.  The locations and estimated quantities associated with Part 2 will be provided to the Contractor at a later time in the form of "work orders".  This legislation authorizes the City to enter into a contract in the amount up to $435,000.00 for the Brick Rehabilitation-2008 project and to pay construction inspection costs up to $65,000.00.  This improvement consists of brick street repair within the City of Columbus and such other work as necessary to complete the contract in accordance with the plans and specifications.  The estimated Notice to Proceed date is May 2008 with a contract duration of 365 days.  This project was let by the Transportation Division and advertised in the City Bulletin, Dodge Reports, and by the Builders Exchange.  Seven bidders/suppliers were solicited (4 majority, 3 minority) and four (4) bids were received (3 majority, 1 minority) on March 13, 2008 and tabulated on March 14, 2008 as follows:

Award is to be made to G&G Cement Contractors, cc #31-0924129 (expires March 7, 2009) as the lowest, best, most responsive and most responsible bidder.
 
The bid proposal stated that the bid quantities were estimated and that the bid quantities may be increased or decreased, depending on the funds available.  Due to the better-than-expected unit prices in the submitted bids, an increased amount of brick rehabilitation work can be completed without exceeding the budget of $500,000.00.  This increase in bid quantities and amount of brick rehabilitation work also includes estimated quantities associated with Part 2 of this contract.  Contract quantities were increased, without changing the ranking of the bids received.
 
The low bidder, G&G Cement Contractors has agreed to the revised quantities at the previously bid unit costs.  Award is to be made to G&G Cement Contractors for $435,000.00.
Fiscal Impact:  This portion of the project is budgeted in the 2007 Capital Improvement Budget.  The $500,000.00 authorized for this project is funded from the Voted 1995, 1999, 2004 Streets and Highways Fund.
 
Emergency action is requested to allow this project to proceed and be completed this construction season.

($500,000.00)
 
Body
WHEREAS, the Transportation Division is responsible for maintaining the City's brick roadways; and
 
WHEREAS, brick rehabilitation is needed to prevent early deterioration of the City's brick roadways; and
 
WHEREAS, formal competitive bids were received on March 13, 2008, and tabulated on March 14, 2008 by the Transportation Division for the Brick Rehabilitation - 2008 project and a satisfactory low bid was received; and
 
WHEREAS, funds are budgeted and available for this expenditure; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that this contract should be awarded so that the work may proceed without delay and be completed this construction season, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to enter into a contract with G&G Cement Contractors, 2849 Switzer Avenue, Columbus, Ohio 43219 for the Brick Rehabilitation - 2008 project in an amount not to exceed $435,000.00 in accordance with the applicable specifications and plans on file in the office of the Transportation Administrator, which are hereby approved, and to provide for construction inspection services in the amount of $65,000.00.  
 
SECTION 2.  That for the purpose of paying the cost of the contract and inspection, the sum of $500,000.00 or so much thereof as may be needed be and hereby is authorized to be expended from Fund 704, the Voted 1995, 1999, 2004 Streets and Highways Fund, Department No. 59-09, Transportation Division, O.L. 01/03 06-6631, OCA Code 644385 and Project 530105(Brick Rehabilitation).
 
SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
