Explanation

1.  BACKGROUND

This ordinance authorizes the Director of Public Service to execute agreements with and to provide funding to the City of Bexley relative to the development of the Bexley and Berwick Joint Livingston Avenue Plan.

The Department of Public Service and the City of Bexley (the “Parties”) are “working jointly… to provide for safe and accessible infrastructure, attractive streetscape, and cooperative development and land use policies in the Livingston Avenue corridor focused on revitalizing the corridor and surrounding neighborhoods of Bexley, Berwick, Eastmoor, and Driving Park”, culminating in the development of the Bexley and Berwick Joint Livingston Avenue Plan. That document will reflect a “common vision for improvements to the corridor, bringing renewed value to the area that provides meaningful physical and cultural connectivity, and enhancements to pedestrian, cyclist, motorist, and public safety”.

The Parties have engaged NBBJ to perform various urban and transportation planning services necessary to the preparation of the Bexley and Berwick Joint Livingston Avenue Plan. The projected cost of said services is $159,000.00, with the Department of Public Service agreeing to pay one-half of that sum. The purpose of this legislation is to enable the Department of Public Service to fulfill that commitment.   

2.  FISCAL IMPACT

Funding in the amount of $79,500.00 is available within the Streets and Highways Bond Fund within the Department of Public Service to support this project. An amendment to the 2020 Capital Improvement Budget is necessary for the purpose of providing sufficient spending authority for the aforementioned expenditure.  A transfer of cash and appropriation between projects within Fund 7704 is needed to align cash and appropriation with the proper project.

 

3.  EMERGENCY DESIGNATION

Emergency action is requested to make requisite construction funding available as soon as reasonably practicable so as to enable the Department of Public Service to satisfy the obligation owed to Bexley in a timely manner and to prevent unnecessary delays in the completion of the Bexley and Berwick Joint Livingston Avenue Plan.

Body

WHEREAS, the Department of Public Service and the City of Bexley (the “Parties”) are “working jointly… to provide for safe and accessible infrastructure, attractive streetscape, and cooperative development and land use policies in the Livingston Avenue corridor focused on revitalizing the corridor and surrounding neighborhoods of Bexley, Berwick, Eastmoor, and Driving Park”; and

 

WHEREAS, the resulting Bexley and Berwick Joint Livingston Avenue Plan will reflect a “common vision for improvements to the corridor, bringing renewed value to the area that provides meaningful physical and cultural connectivity, and enhancements to pedestrian, cyclist, motorist, and public safety”; and

 

WHEREAS, the City of Bexley recently contracted with NBBJ, a global architecture, planning, and design firm, for the provision of various urban and transportation planning services necessary to the preparation of the Bexley and Berwick Joint Livingston Avenue Plan; and

 

WHEREAS, the execution of the prescribed scope of work is expected to cost $179,000.00, with the Parties each agreeing to assume and behalf one-half of the associated expenses; and

 

WHEREAS, the purpose of this legislation is to enable the Department of Public Service to fulfill that commitment; and

 

WHEREAS, this legislation authorizes the Director of Public Service to execute agreements with, and to contribute funding to, the City of Bexley for costs incurred during the completion of the Bexley and Berwick Joint Livingston Avenue Plan; and

 

WHEREAS, it is necessary to authorize an amendment to the 2020 Capital Improvement Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and

WHEREAS, it also is necessary to authorize the transfer of cash and appropriation between projects to align cash and appropriation within the correct project; and

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director to enter into the agreement to make requisite construction funding available as soon as reasonably practicable so as to enable the Department of Public Service to satisfy the obligation owed to Bexley in a timely manner and to prevent unnecessary delays in the completion of the Bexley and Berwick Joint Livingston Avenue Plan, thereby preserving the public health, peace, property, safety and welfare; now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2020 Capital Improvement Budget authorized by Ordinance 2521-2020 be amended as follows to establish sufficient authority for this project:

SECTION 2.  That the transfer of $79,500.00, or so much thereof as may be needed, is hereby authorized within Fund 7704 (Streets and Highways Bond Fund), from Dept-Div 5913 (Division of Traffic Management), Project P540006-100000 (Traffic Maintenance - Commodities), Object Class 06 (Capital Outlay) to Dept-Div 5912 (Division of Design and Construction), Project P530161-100217 (Roadway - Livingston Ave - Nelson Rd to James Rd), Object Class 06 (Capital Outlay per the accounting codes in the attachment to this ordinance.

SECTION 3.  That the Director of Public Service be and hereby is authorized to enter into agreements with, and to make payment to, the City of Bexley relative to the development of Bexley and Berwick Joint Livingston Avenue Plan.

SECTION 4.  That the expenditure of $79,500.00, or so much thereof as may be needed, is hereby authorized within Fund 7704 (Streets and Highways Bond Fund), from Dept-Div 5912 (Division of Design and Construction), Project P530161-100217 (Roadway - Livingston Ave - Nelson Rd to James Rd), Object Class 06 (Capital Outlay per the accounting codes in the attachment to this ordinance.

SECTION 5.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

SECTION 7.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

SECTION 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
