Need: To purchase twenty-eight (28) tactical vests for the protection of the Division of Police S.W.A.T. Unit, this critical equipment is used during barricade deployment and slow searches as well as other S.W.A.T. operations.
Bid Information: A formal bid, Solicitation No. SA001841 was opened on December 1, 2005.
All suppliers were deemed non-responsive to the formal bid request, SA001841, Purchase of Tactical Body Armor. Due to research and investigations on this type of product, it has taken over seven months to finalize this process and there would be no advantages to rebidding this item. The Division of Police is requesting cancellation of the original bid, SA001841 and for all bids to be considered informally.
The Purchasing Office has contacted the most responsive, responsible and best bidder, Roy Tailors Uniform Co. of Columbus and the supplier is willing to allow the bid to be considered informally at the same pricing. The lowest bid meeting specifications was accepted. The other suppliers submitted alternates items, which did not meet construction, ballistic panel weight or plate weight. The cheaper construction technique compromises the ability of the vest to protect the wearer against rifle caliber threats. This company is not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.

Emergency Designation: Emergency legislation is being requested in order to outfit the S.W.A.T. Unit with the appropriate vest protection as soon as possible.
FISCAL IMPACT: Funds have been appropriated from Law Enforcement Contraband Seizure Funds per Ordinance 0060-2006 passed February 6, 2006; there will be no effect on the financial status of the General Fund Budget.

To authorize and direct the Finance & Management Director to enter into a contract with Roy Tailors Uniform Co. of Columbus, Inc. for the purchase of tactical body armor, and to authorize the expenditure of $56,950.00 from the Law Enforcement Seizure Fund; to waive the competitive bidding provisions of the Columbus City Codes; and to declare an emergency. WHEREAS, the Division of Police needs to purchase tactical body armor for the S.W.A.T. Unit; and
WHEREAS, formal bid SA001841 for the purchase of tactical body armor was completed by the Purchasing Office on December 1, 2005; and
WHEREAS, all responses to the formal bid were deemed non-responsive; and
WHEREAS, the Division of Police is requesting cancellation of the original bid, SA001841 and for all bids to be considered informally; and
WHEREAS, the most responsive, responsible and best bidder is Roy Tailors Uniform Co. of Columbus, Inc.; and
WHEREAS, it is in the best interest of the City that competitive bidding be waived; and
WHEREAS, an emergency exists in the usual daily operation of the Division of Police, Department of Public Safety, in that it is immediately necessary to purchase tactical body armor for the protection of our S.W.A. T. Unit for the Division for the preservation of public health, peace, property, safety and welfare; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Finance and Management Director be and is hereby authorized and directed to enter into contract for the purchase of tactical body armor with Roy Tailors Uniform Co. of Columbus, Inc. in the amount of $56,950.00 for the Division of Police.
Section 2. That in accordance with Section 329.27 of Columbus City Codes, this Council finds it is in the best interest of the City of Columbus to waive the provisions of Section 329.06 of the Columbus City Codes to permit the aforementioned purchase.
Section 3. That the expenditure of $56,950.00, or so much thereof as may be needed, be and same is hereby authorized as follows:

Section 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be enforced from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
