Explanation
 
BACKGROUND: This legislation authorizes the Director of Public Utilities to enter into a construction contract with York Electrical, Inc. for the Jackson Pike Wastewater Treatment Plant (JPWWTP) Maintenance Building Electrical Power Feed Expansion project. The JPWWTP Maintenance Building Renovations, Contract SCP 01JP will provide additional electrical loads that will exceed the existing capacity of the Maintenance Building's electrical power feeder and distribution center. This construction contract, SCP 04JP Jackson Pike Wastewater Treatment Plant Maintenance Building Electrical Power Feed Expansion, is a high-priority project that will provide a sufficient amount of electrical power to the JPWWTP Maintenance Building, including the additional loadings from the new equipment to be installed in the SCP 01JP project, with capacity to spare.  This project will also update the Arc-Flash calculations and labeling requirements and bring the Maintenance Building and the main electrical distribution center in the Incinerator Building into compliance with the NFPA 70E, 2012 Standards.  Environmental and permitting requirements will also be addressed in the design, including City Building and Zoning Services requirements and Permits to Install.
PROJECT TIMELINE: Contract work is required to be completed in a manner acceptable to the City within 90 days from the date that a Notice to Proceed (NTP) is given by the City.
PROCUREMENT:  The Division advertised for competitive bids submission for the subject services on the City's Vendor Services website and in the City Bulletin in accordance with the provisions of Section 329.09 of the Columbus City Code. The Division of Sewerage and Drainage received three (3) bids on July 23, 2014 from the following companies:

The bids were reviewed and ranked utilizing the Bid Tab and Quality Factor Form process. After reviewing the bids and the QFF form, it was determined that York Electrical, Inc. was the lowest responsive, responsible, and best bid. The Engineer's Estimate was $590,400.00

Emergency Designation: The Department of Public Utilities is requesting emergency legislation at this time. This construction contract, SCP 04JP Jackson Pike Wastewater Treatment Plant Maintenance Building Electrical Power Feed Expansion, is required to be performed simultaneously with a separate construction contract within the same building that has already been awarded.  This construction contract is going to provide the expanded power feed necessary to supply the new equipment being installed in the separate construction contract.
Economic Impact: This project will provide more efficient upgraded electrical wiring and equipment to better utilize electrical power more economically.  Higher efficiency of the new equipment should provide an additional environmental advantage in the Plant's usage of electricity. No community outreach factors are considered for this project.
Fiscal Impact: The legislation authorizes a transfer and authorizes the expenditure of up to $265,440.00 from the Sanitary Sewer General Obligation Bond Fund, Fund 664 and authorizes an amendment to the 2014 Capital Improvements Budget.

WHEREAS, the Department of Public Utilities advertised for competitive bids for the Jackson Pike Wastewater Treatment Plant (JPWWTP) Maintenance Building Electrical Power Feed Expansion project on the City's Vendor Services website and in the City Bulletin in accordance with the provisions of Section 329.09 of the Columbus City Code; and
 
WHEREAS, three companies submitted bids that were reviewed and ranked utilizing the Bid Tab and Quality Factor Form process and it was determined that York Electrical, Inc. be awarded the construction contract; and,
 
WHEREAS, it is necessary to transfer and expend up to $265,440.00 within the Sanitary Sewer General Obligation Bond Fund, Bond Fund 664; and
 
WHEREAS, it is necessary to amend the 2014 Capital Improvements Budget for purposes of creating and providing sufficient budget authority for the aforementioned expenditures; and
WHEREAS, an emergency exists in the usual daily operations of the Department of Public Utilities in that it is immediately necessary to authorize the Director to enter into contract with York Electrical, Inc. in order to prevent delays in another construction contract all for the preservation of the public health, peace, property, safety, and; Now, Therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.   That the Director of Public Utilities be, and hereby is, authorized to enter into a construction contract with York Electrical, Inc., 530 East Second Street, Dayton, Ohio 45401 for the Jackson Pike Wastewater Treatment Plant (JPWWTP) Maintenance Building Electrical Power Feed Expansion project, in accordance with the terms and conditions as shown in the contract modification on file in the office of the Division of Sewerage and Drainage.
SECTION 2.  That the City Auditor be and hereby is authorized and directed to transfer a total of $265,440.00 from within the Sanitary Sewer General Obligation Bond Fund | Fund No. 664 | Division 60-05 | Obj. Lvl 3 6624:

SECTION 5.   That the said firm, York Electric Inc., shall perform the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
SECTION 6.   That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
SECTION 7.   That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 8.   That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 9.   That for reasons stated in the preamble hereto, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
