Explanation
 
In 1997, the City of Columbus acquired approximately 74 acres +/- of real property located in the vicinity of Spindler Road and Summerlawn Drive, and commonly known as Spindler Park, for the purpose of providing an active recreation area to the surrounding community and to complete the park's entire boundaries.  The City now desires to acquire the remaining out lot identified as 2085 Spindler Road (200-003686 TID#).  After investigation by the Department of Recreation and Parks, it has been determined that this acquisition will consolidate the park properties, relieve possible proximity issues with residential homes, and improve park programming.  The following is an ordinance to authorize the City Attorney to acquire fee simple title and lesser interests, contract for professional services, and to expend the monies for payment of acquisition costs in connection with the Spindler Road Parkland Acquisition Project.
 
 
Fiscal Impact:
$299,803.35 is required and budgeted in the Voted Recreation and Parks Bond Fund to meet the financial obligations of these various expenditures -
 
 
 
Emergency Justification: Emergency action is requested to allow for the continued acquisition of those properties necessary to relieve possible proximity issues with residential homes in the park area, and to improve park programming

WHEREAS,      Spindler Road Parkland Acquisition Project in 1997, the City of Columbus acquired approximately 74 acres +/- of real property located in the vicinity of Spindler Road and Summerlawn Drive, and commonly known as Spindler Park, for the purpose of providing an active recreation area to the surrounding community and to complete the park's entire boundaries; and
 
WHEREAS,       the City now desires to acquire the remaining out lot identified as 2085 Spindler Road (200-003686 TID#); and
 
WHEREAS,       after investigation by the Department of Recreation and Parks, it has been determined that this acquisition will consolidate the park properties, relieve possible proximity issues with residential homes, and improve park programming; and
 
WHEREAS, funds are being moved to alternate project within Fund 702 to establish correct funding location for this project; and
 
WHEREAS,      an emergency exists in the usual daily operation of the Recreation and Parks Department, in that it is immediately necessary to authorize the City Attorney to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary in connection with said project for the preservation of the public health, peace, property and safety; now, therefore:
 
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
SECTION 1.      That the City Attorney be, and hereby is, authorized to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary in connection with the Spindler Road Parkland Acquisition Project, #510112-100020.
 
 
SECTION 2. That the City Auditor is hereby authorized to transfer $299,803.35 within the voted Recreation and Parks Bond Fund No. 702 for the projects listed below:

SECTION 3.   That the expenditure of $299,803.35, or so much thereof as may be necessary, be and is hereby authorized from the Voted Recreation and Parks Voted Bond Fund No. 702, Dept. 51-01 as follows: $299,803.35 Project No. 510112-100020 Spindler Rd. Parkland Acquisition project, Object Level 3 #6601, OCA Code 721220
SECTION 4.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
      
SECTION 5.      That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 6.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
