Explanation

 

 

BACKGROUND:   This ordinance amends Title 11, Chapter 1163, of the Columbus City Code, 1959, to reflect changes in Municipal Electric Rates charged by the Department of Public Utilities, Division of Power and Water, for electric services.  It is also requested that some sections of the chapter be repealed as they are no long applicable.

 

Under the authority of Ordinance 1866-2004, the Erora Group, LLC, was contracted to provide power supply planning and related services.  As a subcontractor for the Erora Group., LLC, the Prime Group has conducted a rate study and has made recommendations for new rates based upon the current costs for purchased power and distribution.  

 

 

Title

 

 

To amend and repeal various sections of Title 11, Chapter 1163, of the Columbus City Code, 1959, pertaining to Municipal Electric Rates.

 

Body

 

WHEREAS, the City of Columbus, Department of Public Utilities, contracted with the Erora Group for purchase power planning services; and

 

WHEREAS, the Prime Group, as a subcontractor under the aforesaid contract, conducted a rate study and has recommended changes in electric rates to reflect the city's current costs of purchased power and distribution; and

 

WHEREAS, the Department of Public Utilities, Division of Power and Water, wishes to amend the Columbus City Code, 1959, Title 11, Chapter 1163, pertaining to Municipal Electric Rates; now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That Title 11 of the Columbus City Codes, 1959, be amended by modifying the following:

 

Chapter 1163 MUNICIPAL ELECTRIC RATES

 

1163.01 Definitions.

(a) "Maximum capacity" means the sum of the individual demands as determined separately for each metered service and supplied under the provisions of this chapter.

(b) "Individual demand" means the measured demand where the connected load on a metered service is in excess of twenty (20) kilowatts; where the connected load is twenty (20) kilowatts or less, the individual demand may be established by periodic test, or as the estimated demand derived from the connected load.

(c) "Measured demand," either by permanent installation of a demand meter or by periodic test, shall be determined in accordance with the division's standard practices and, except in unusual cases, shall be the maximum fifteen minute integrated kilowatt demand recording of an integrating demand meter, or the highest registration of a thermal type demand meter, during the billing period. In instances of highly fluctuating loads, or demands of short duration, the measured demand may be determined by appropriate metering equipment designed to measure fully the impact of such demands. Where measured demand are determined by periodic test a measured demand so determined shall continue in effect until superseded by a subsequent test.

(d) "Estimated demands" means a calculated demand figure determined from the connected load, as follows:

First 5,000 watts @ 90%

Next 5,000 watts @ 80%

Over 10,000 watts @ 70%

(e) "Contract location" means each separate point of delivery of service metered and billed under a separate service contract. Under special conditions, two (2) or more services supplied to a consumer at one (1) "contract location" may be combined on one (1) service contract as determined by the Director of Public Utilities or designee under the applicable schedule.

(f) "Service" means the conductors and equipment for delivering electric energy from the secondary distribution main, or from the transformer, or from a distribution feeder to the wiring system of the premises served.

(g) "Sub-station" means a receiving point for electric energy consisting of transformers, voltage regulators, switches and miscellaneous equipment and appurtenances.

(h) "Commercial service" means electric energy delivered to commercial enterprises such as stores, hotels, offices, schools, churches, hospitals, apartment buildings, rooming or boarding houses, sales rooms, shops and a combined residence and office.

(i) "Industrial service" means electric energy delivered to factories, processing plants, manufacturing plants and similar industries.

(j) "Residential service" means electric energy delivered to residences. (Ord. 972-94.)

(k) The off-peak period shall be the time between 7:00 p.m. of each week day and 7:00 a.m. of the following day, between 5:00 p.m. on Friday and 7:00 a.m. of the following Monday and all day of New Year's Day, President's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day. The hours of the off-peak period above defined shall be subject to change from time to time at the city's option, provided that the week day off-peak period shall not be reduced to less than eight (8) hours. On-peak hours are all hours not defined as off-peak hours. (Ord. 2743-95.)

(l) "Eligible senior customers" means any customer who (a) is receiving, service by means of a single meter to a single family residence; (b) is personally responsible for payment of the bill as head of household; and (c) is sixty-five (65)  sixty (60) years of age or older having a total income of less than 150% of the poverty level as published by the U.S. Department of Commerce, Bureau of Census.

(m) "Total income" means adjusted the gross income of the applicant and spouse for the year preceding the year on which application for the senior citizen adjustment is made, as determined under the "Internal Revenue Code of 1954," 26 U.S.C. 1, as amended, plus income from the following sources not included in the federal adjusted gross income: old age and survivors benefits received pursuant to the "Social Security Act," retirements, pensions, annuities, payments received pursuant to the "Railroad Retirement Act," 45 U.S.C. 228, and interest on federal, state and local government obligations. Disability benefits paid by the Veterans Administration or a branch of the armed forces of the United States on account of an injury or disability shall not be included in total income. 1163.03 Power cost reserve adjustment.

The power cost reserve adjustment includes the power cost adjustment (PCA) and the operating reserve allocation (ORA). The power cost reserve adjustment formula is as follows:

Power cost reserve adjustment = PCA + ORA

The rates set forth in the applicable rate schedules are based upon a PCB or power cost base of $0.06419 $0.01579 per KWH. This base does not include all purchase power costs incurred; therefore, monthly, the power cost adjustment (PCA) formula is to be used to pass through purchase power costs incurred. Consumer electric bills may increase or decrease depending on the purchase power costs incurred and will be adjusted to the electric customer's bill based upon energy consumption used (PCA times KWH consumption billed).

(1) "PCA" is the power cost adjustment calculation to determine monthly purchase power cost of service and to adjust for reserve and operating cost allocations in the electric rates. The power cost adjustment charge or credit shall be determined within the nearest 1/1000 of a KWH in accordance with the following formula:

PCA = ((Pm/(Egm+Epm) - PCB) × ((Egm + Epm)/Esm)

 

PCA = Power cost adjustment to be charged in accordance with the power cost reserve adjustment as set forth within this chapter. The power cost adjustment amount per KWH will be charged times the energy used during the current billing month along with the electric rates established in this chapter.

Pm = Net cost of purchased power for the third month preceding the current billing month.

Egm = Net energy produced by the O'Shaughnessy Generating Plant for the third month preceding the current billing month.

Epm = Net energy purchased from other parties during the third month preceding the current billing month.

Esm = Total metered energy sales from customer meters read during the third month preceding the current billing month.

PCB = Power Cost Base = $0.06419  $0.01579 per KWH.

(2) "ORA," the operating reserve allocation component of the power cost reserve adjustment, is an upward or downward adjustment in power cost reserve adjustment rate level as determined necessary by the Director of Public Utilities or designee to maintain competitive rates and/or to provide revenue to meet established Project 2020 goals. The director or designee may set or adjust the ORA monthly; provided, in no event, shall the director or designee set or adjust the ORA level to be greater than $0.008 per KWH above the PCA for the third month preceding.

The power cost reserve adjustment shall be expressed in dollars per kilowatt-hour. The adjustment shall be effective at the beginning of each month to reflect adjustments made for purchase power costs incurred during the third month preceding and reflect ORA adjustment to the current month's billing cycle. 1163.04 Residential electric service, Schedule "A" (Rate 10).

 

Availability:

Residences, Apartments and Dwelling Units providing domestic accommodations for an individual family.

Type of Service:

The service shall be supplied at 120/240 volts, single phase, 60 hertz, alternating current from the Division of Power and Water's distribution system.

Permitted use:

For lighting, heating, cooking, refrigeration, and miscellaneous appliances as commonly used in a domestic dwelling.

Rates:

Minimum charge:

Minimum monthly charge per meter for service shall be the customer charge.

Senior Citizen Adjustment:

The total charges for all kilowatt-hours of energy supplied pursuant to this section to any eligible senior customer in the period covered by any bill shall be decreased by ten (10) percent.  In no event shall the senior citizen adjustment reduce the bill below the minimum monthly charge.

1163.05 Residential electric service, Schedule "A-l" (Small User, Rate 11).

 

                     Availability:

                     Residences, Apartments and Dwelling Units providing domestic accommodations for an individual family. Any new customer or an existing customer who changes service location will be billed under Schedule "A" until the first billing month during the summer period, unless such customer establishes to the satisfaction of the Division of Power and Water that his usage would be within the limits provided in this schedule.

                     Type of Service:

                     The service shall be supplied at 120/240 volts, single phase, 60 hertz, alternating current from the Division of Power and Water's distribution system.

                     Permitted Use:

                     For lighting, heating, cooking, refrigeration, and miscellaneous appliances as commonly used in a domestic dwelling.

                     Rates:

                     Applicable to each separately metered service:

                     In any summer billing month if usage exeeds 700 KWH, billing will be rendered that month under Schedule "A" and thereafter for all subsequent months through the four months of next summer period.

                     Seasonal Periods:

                     Power Cost Reserve Adjustment:

                     The above schedule of charges shall be adjusted in accordance with the Power Cost Reserve Adjustment as set forth in this chapter.

1163.06 Small commercial electric service, Schedule "C-S" (Rate 20A and 22A).

 

                     Availability:

                     Available for general light and power service to consumers using City's standard service for the purposes other than residential use, and whose demand is less than 10 KW.

                     Type of Service:

                     Alternating current, 60 hertz, delivered from the City's secondary distribution systems at nominal voltages of 120, 120/240, 120/208, 240, 277/480 or 480 volts, single phase, and 120/208, 120/240, 208, 240, 277/480 and 480 volts, 3 phase.  Service of at least one of the foregoing characteristics shall be made available to a customer, the particular service characteristics to be at the option of the City.

                     Rates:

The above tariff is net if account is paid in full within 15 days of the date of bill.  On all accounts not so paid, an additional charge of five percent (5%) of the total amount billed, but not less than one dollar ($1.00) will be made.

Service and Contract Provisions:

Each separate point of delivery of service by one of more Metered Services shall be considered a Contract Location and shall be metered and billed under a separate service contract.

Only one Metered Service of each type, as to voltage and phase, will be supplied to a consumer under this Schedule at one Contract Location.  Where two or more services are supplied to a consumer at one Contract Location, said services, within the limitations above stated, may be combined in one service contract under this schedule, or may be served under separate contracts under this or other applicable schedules, at the consumer's option.

Term of contract:

Unless otherwise provided, the term of contract for service under this Schedule shall not be less than one (1) year.

1163.065 Commercial electric service, Schedule "C" (Rate 20, 22, and 39).

 

                     Availability:

                     Available for general light and power service to consumers using City's standard service for the purposes other than residential use with a maximum demand is excess of 10 KW.

                     Type of Service:

                     Alternating current, 60 hertz, delivered from the City's secondary distribution systems at nominal voltages of 120, 120/240, 120/208, 240, 277/480 or 480 volts, single phase, and 120/208, 120/240, 208, 240, 277/480 and 480 volts, 3 phase.  Service of at least one of the foregoing characteristics shall be made available to a customer, the particular service characteristics to be at the option of the City.

                     Rates:

                     Applicable to each separately metered service:

Only one Metered Service of each type, as to voltage and phase, will be supplied to a consumer under this Schedule at one Contract Location.  Where two or more services are supplied to a consumer at one Contract Location, said services, within the limitations above stated, may be combined in one service contract under this schedule, or may be served under separate contracts under this or other applicable schedules, at the consumer's option.

Term of contract:

Unless otherwise provided, the terms of contract for service under this Schedule shall not be less than one (1) year.

1163.066 Commercial primary electric service, Schedule "CP". (Rate 22P)

Availability:

Available for general light and power service to consumers with a low load factor using city's standard primary electric service for the purposes other than residential use with a maximum demand in excess of 10 KW.

Type of Service:

Alternating current, 60 hertz, delivered from the city's electric distribution systems at nominal voltages of 7200, through 14,400 volts, three phase. Service of at least one (1) of the foregoing characteristics shall be made available to a customer, the particular service characteristics to be at the option of the city.

Rates:

Applicable to each separately metered service:

Optional Time-of-Day Provision:

At the request of a customer whose measured demand during off-peak hours normally exceeds measured demand during on-peak hours, the city will install metering equipment to determine the measured demand during both o-peak and off-peak hours. The total installed cost of such metering equipment in excess of the cost of the metering equipment that is necessary to determine the consumers single highest measured demand during the month may (at the city's discretion) be paid for by the consumer.

For those consumers whose measured demand is determined during both on-peak and off-peak hours, maximum demand in any hall be the greater of:

(a) Te measured demand during on-peakhours of th current month; or

(b) The minimum billing demand, if any, specified in the serviceconract.

The off-peak demand shall be the amount by which the demand created during off-peak period exceeds the monthly demand.

The on-peak billing period shall be as defined in the definitions section.

Service and Contract Provisions:

Only one metered service of each type, as to voltage and phase, will be supplied to a consumer under this schedule at one (1) contract location.

Each separate point of delivery of service by one (1) or more metered services shall be considered a contract location and shall be metered and billed under a separate service contract. Where two (2) or more services are supplied to a consumer at one contract location, said services, within the limitations above stated, may be combined in one (1) service contract under this schedule, or may be served under separate contracts under this or other applicable schedules, at the consumer's option.

Term of Contract:

Unless otherwise provided, the term of contract for service under this schedule shall not be less than one (1) year.

1163.07 Large commercial and industrial secondary electrical service, Schedule "LCI" - (Rate 23S and 31).

                     Availability:

                     Available for general light and power use to the customers generally establishing maximum demand in excess of 50 KW.

Type of service:

Alternating curent, 60 hertz, delivered from the city's electric distribution system at nominal voltages

of 120, 120/240, 120/208, 240, 240/480, 480, 277/480 volts single phase; and 120/208, 120/240, 208, 240, 480, 277/480 and 2300 volts, three phase. Service of at least one (1) of the foregoing characteristics shall be made available to a customer, the particular service characteristics to be at the option of the city.

maximum demand, the customer charge, and any applicable energy charge and power cost reserve adjustment.

Delayed Payment Charge:

The above tariff is net if account is paid within fifteen (15) days of date of bill. On all accounts not

so paid, an additional charge of five (5) percent of the total amount billed, but not less than one dollar ($1.00) will be made.

Determination of Maximum Demand:

The maximum demand shall be the sum of the individual demands of each metered service supplied

under the provisions of this schedule.

For those consumers whose measured demand is determined during both on-peak and off-peak hours,

maximum demand in any month shall be the greater of:

(a) The measured demand during on-peak hours of the current month; or

(b) The minimum billing demand, if any, specified in the service contract; or

(c) 50 KW.

For all other consumers, all hours are considered as on-peak hours.

Excess Demand:

The excess demand in any month shall be the amount by which the measured demand during off-

peak hours of the current month exceeds the maximum demand for the month.

Service and Contract Provisions:

Each separate point of delivery of service by one or more metered services shall be considered a contract location and shall be metered and billed under a separate service contract.

Only one (1) metered service of each type, as to voltage and phase, will be supplied to a consumer under this schedule at one (1) contract location. Where two (2) or more services are supplied to a consumer at one (1) contract location, said services, within the limitations above stated, may be combined in one (1) service contract under this schedule, or may be served under separate contracts under this or other applicable schedules, at the consumer's option.

Term of Contract:

Unless otherwise provided, the term of contract for service under this schedule shall not be less than

1163.075 Large commercial and industrial primary electric service, Schedule "LCI-P". (Rate 23P)

Availability: Available for general light and power use to the customers generally establishing maximum demand in excess of 50 KW.

Type of service: Alternatingrrent, 60 hertz, delivered from the city's electric distribution system at

nominal voltages of 2300, 7200, 13,200, 13,800, and 14,400 volts, three phase. Service of at least one (1) of the foregoing characteristics shall be mavailable to a customer, the particular service characteristics to be at the option of the city.

       Rates: Applicable to each separately metered service

Where two (2) or more services are supplied to a consumer at one (1) contract location, said services, within the limitations above stated, may be combined in one (1) service contract under this schedule, or may be served under separate contracts under this or other applicable schedules, at the consumer's option.

Term of contract: Unless otherwise provided, the term of contract for service under this schedule shall not be less than one (1) year. (Ord. 972-94.)

 

1163.08 Standby electric service.

Applicability:

To various customers, as classified by rate schedules, desiring a permanent standby service connection for use in case of emergency, or whenever the usual source of supply is inadequate.

Type of Service:

Alternating current at the City's standard conditions supplied from its secondary or primary distribution mains.

Electric Rate:

The same as set forth in the various applicable rate schedules herein, provided that the minimum monthly bill rendered will not be less than $5.50 per KW of required standby capacity maintained for the customer.

1163.12 Private area lighting (overhead).

Availability: Available for the lighting of private areas to customers of the Division of Power and Water.

Type of Service: Private Area Lighting which consists of a metal halid, mercury vapor, high pressure sodium or a low pressure sodium luminaire mounted with a six foot bracket on a wood utility pole served by overhead facilities.

Lighting from dusk to dawn, controlled by a photo-electric relay.

For each 175 foot span of wire or part thereof, the charge will be seventy cents ($.70) two dollars and ninety-five cents ($2.95) per month.

Operation and Maintenance: The City will supply electric service to operate lamps and will furnish, install and maintain lamps and fixtures. The customer shall promptly notify the City of outages.

Term of Contract. The term of contract for the area light service shall not be less than three (3) years.

Special Provisions: The determination of the method of supply and type of facilities rests solely within the City.

The customer shall provide such cleared rights-of-way, licenses, and permits as may be required to enable the City to supply the service applied for.

Service will not be provided hereunder if in the judgment of the City a danger or nuisance will be created thereby. Service will be terminated if after installation it proves to be a danger or nuisance.

SECTION 2.  That Sections 1163.076, Interruptible power and  1163.078, Large commercial and industrial electrical service, Schedule "LCI-T, be and are hereby repealed.

 

1163.076 Interruptible power, Schedule "IRP".

Availability: Service pursuant to this schedule is available to customers that have provided reasonable evidence to the city that their electric service can be interrupted within a ten (10) minute notice period. Customers shall contract with the city for electrical capacity sufficient to meet normal maximum requirements but not less than one thousand (1,000) KVA of interruptible capacity.

The total interruptible power contract capacity for all customers serviced under this schedule and all other interruptible power schedules, contracts and agreements offered by the city, will be limited to seventy-five thousand (75,000) KVA. Loads of new customers locating within the city's service area or load expansions by existing customers may be offered interruptible service as part of an economic development or competitive response incentive. Such interruptible service shall not be counted toward the limitation on total interruptible power contract capacity, as specified above, and will not result in a change to the limitation on total interruptible power contract capacity.

The city communicates interruption or curtailment conditions to the customer, monitors customer load and receives customer replacement electricity decisions through its load dispatch center.

Definitions:

Curtailment: A reduction in firm or nonfirm transmission service in response to a transmission capacity shortage as a result of system reliability conditions.

Interruption: A reduction in nonfirm transmission service due to economic reasons.

Interruption and curtailment conditions:

(a) The city reserves the right to curtail service under this schedule when, in the sole judgement of the city, a capacity deficiency exists or is projected to exist on the city of Columbus, Division of Power and Water, system. A capacity deficiency shall mean any instance in which the Division of Power and Water system's available purchase power or generating capacity is insufficient to satisfy its load requirements. When a curtailment is called for, service to the customer will be curtailed in accordance with the Division of Power and Water critical customer load list. The duration or frequency of such capacity deficiency curtailments shall not be limited.

(b) The city also reserves the right to interrupt service under this schedule when, in the sole judgment of the city, the city can receive a higher price from an alternative buyer for the electricity that otherwise would have been sold to the customer. The duration or frequency of such economic interruptions shall not be limited. The customer may avoid an economic interruption by agreeing to pay the price available to the city from the alternative buyer.

Interruption and curtailment notice:

(a) The city will endeavor to provide the customer as much advance notice as possible of a capacity deficiency curtailment. To the extent feasible, capacity deficiency curtailments shall begin and end on the clock hour or half hour. However, the customer will be required to interrupt service within ten (10) minutes if so requested by the city. The city and the customer may agree by contract on alternative arrangements regarding start and end times for capacity deficiency curtailments. In system emergency situations, the customer will be required to interrupt service immediately.

(b) The city will provide the customer as much advance notice as possible of a potential economic interruption. To the extent feasible, economic interruptions shall begin and end on the clock hour or half hour.

Failure to comply with a request for interruption or curtailment:

(a) If the customer fails to curtail load as requested by the city for a capacity deficiency, the customer will be required to refund all rate discounts received under this schedule during the preceding twelve (12) months for the uninterrupted demand. If the customer fails to curtail load the demand will be calculated as the difference between the maximum thirty (30) minute integrated demand during each capacity deficiency curtailment and the sum of the customer's contract capacities under any schedule where service is not interrupted. The rate discount will be the difference between the demand charge as specified in this schedule and the Schedule LCI-P demand charge.

(b) If the customer fails to interrupt load as requested by the city during an economic interruption, the entire uninterrupted demand will be billed at the price available to the city from the alternative buyer for the duration of the requested economic interruption. The uninterrupted demand will be calculated as the difference between the maximum thirty (30) minute integrated demand during each economic interruption and the sum of the customer's contract capacities under any schedule where service is not interrupted.

(c) If the customer fails to interrupt or curtail load as requested by the city during either a capacity deficiency curtailment or an economic interruption, the city further reserves the right to:

(1) Interrupt the customer's entire load.

(2) Discontinue service to the customer under this schedule if the customer fails to interrupt load twice during a twelve (12) month period as requested by the city. The city may thereafter charge the customer, as specified in the term of contract provision of this schedule, for any additional costs beyond the firm service rate incurred by the city as a result of the customer transferring to firm service without providing proper notice.

Term of contract: The customer shall contract for capacity sufficient to meet normal maximum power requirements, but in no event will the amount of interruptible capacity contracted for be less than one thousand (1,000) KVA at any delivery point. The city will not be required to supply capacity in excess of that contracted for except by mutual agreement. In the absence of such agreement, if the customer's demand exceeds the contract capacity, the city may promptly notify the customer to reduce demand and may interrupt the service if such reduction is not accomplished.

Contracts under this schedule shall be made for an initial period of not less than five (5) years and shall remain in effect unless either party shall give at least one (1) year's written notice to the other of the intention to discontinue interruptible service from the city.

A new initial contract period will not be required for existing customers who increase their contract capacity requirements after the original notice period unless new or additional facilities are required, in which case, the city may, at its option, require a longer initial contract period.

The customer will be required to provide a one (1) year's notice prior to transferring to firm service with the city. Concurrent with providing the city with notice to transfer to firm service, the customer will also be required to enter into a firm service contract or agreement that will become effective at the end of the notice period.

The customer may transfer to firm service with the city with less than one (1) year's notice, upon mutual agreement between the customer and the city, subject to the following conditions:

(a) If the city has sufficient capacity to provide the customer firm service and would incur no additional costs beyond the firm service rate until after the five (5) year contract notice requirement is fulfilled, the customer will be billed under the applicable firm service schedule,

(b) If the city has insufficient capacity to provide the customer firm service prior to the expiration of the notice period, the customer will be billed under the applicable firm service schedule plus all additional costs incurred by the city in obtaining power from alternative electricity suppliers in order to provide firm service to the customer.

Firm service designation: In the event the customer requires service which is not subject to interruption as provided for under this schedule, such service shall either be, (a) separately supplied and metered under the provisions of a schedule applicable to the type of service which the customer requires, or (b) billed under the provisions of LCI-P, less customer charge. If such firm service is billed under the provisions of Schedule LCI-P, the customer will not be subject to the minimum contract demand of one thousand (1,000) KVA.

The customer must designate a firm service contract capacity for such service.

Replacement electricity: When an economic interruption condition arises pursuant to the interruption and curtailment conditions provision contained herein, and if requested by the customer, the city will use its best efforts to obtain and deliver replacement electricity at the lowest reasonable cost available in order for the customer to avoid an interruption.

The customer will be required to specify an hourly KVA capacity, in multiples of one thousand (1,000) KVA, of replacement electricity thatte city will obtain and deliver.

The prchase and delivery of such replacement electricity will be subject to the following terms and conditions of service:

(a) The customer agrees to pay all applicable costs incurred by the city in obtaining and delivering the hourly KVA capacity of replacement electricity specified by the customer including all applicable Federal Energy Regulatory Commission jurisdictional transmission charges.

(b) Best efforts shall mean actions of the city, or the city's designee, that are reasonable, prudent, and consistent with good utility practice. Best efforts do not include fiduciary or extraordinary actions.

(c) In order to emtte customer to verify the cost incured by the city in obtaining replacement electricity, the customer will be permitted reasonable access to all pertinent documents relating to the purchase of replacement electricity by the city.

(d) Once replacement electricity is being supplied to the customer, if the customer is notified that replacement electricity is no longer available, the terms of this provision will cease to apply and the customer must comply with other provisions of this schedule regarding interruption.

(e) If any replacement electricity source fails to deliver scheduled replacement electricity, the city reserves the right to interrupt service to the customer. Further, the customer will indemnify and hold the city harmless for any damages to persons or property occurring at the customer's premises resulting from the interruption of the customer when the replacement electricity source fails to deliver eplacement electricity as scheduled.

(f) The city reserves the right to interrupt the ale of replaement electricity to the customer if, in the sole judgment of the city, such electricity is required to maintain service to the city's customers with a higher priority of service according to the Division of Power and Water critical customer load list for system integrity. Any such interruption shall be remedied as quickly as reasonably possible and must be preceded by the exhaustion of other reasonable alternatives consistent with good utility practice to avoid the interruption.

(g) All costs of any metering, communications and other equipment necessary for providing replacement electricity will be borne by the customer. Such costs will include the costs of any equipment required to verify the scheduled delivery of replacement electricity from a replacement electricity source to the city.

(h) The customer will be responsible for all costs resulting when the demand exceeds the replacement electricity capacity specified by the customer. The city will compensate the customer for replacement electricity delivered but not used by the customer up to the city's avoided cost of generation or purchase power at the time the replacement electricity was delivered.

(i) In the event the city's transmission system is capable of importing only a portion of the requested replacement electricity, the city shall use its best efforts to fairly apportion available replacement electricity between customers which have requested it.

Type of service: Alternatig current, sixty (60) hertz, delivered from the city's electric distribution system at nominal three (3) phase voltages. Service of at least one (1) of the foregoing characteristics shall be made available to a customer, the particular service characteristics to be at the option of the city.

Minimum charge: Minimum monthly charge per meter for service shall be the customer charge.

Delayed payment charge: The above tariff is net if account is paid in full within fifteen (15) days of the date of bill. On all accounts not so paid, an additional charge of five (5) percent of the total amount billed, but not less than one dollar ($1.00) will be charged.

Power cost reserve adjustment (PCRA-IR): The above schedule of charges shall be adjusted in accordance with the power cost reserve adjustment as set forth in this chapter. Reference Section 1163.03 for power cost reserve adjustment calculation. The calculation will be the same for the PCRA-IR interruptible rate with the following exceptions. The PCRA-IR will be adjusted monthly based upon special purchase power costs and transmission costs incurred through replacement electricity power contract(s) for interruptible power. Also, when calculating the PCA formula under Section 1163.03 (1), exclude (Egm = Net energy produced by the O'Shaughnessy Generating Plant) and all other outside sources of firm power that were not purchased for the customer(s) that are eligible under Section 1163.076 of this rate schedule.

Monthly billing demand: The billing demand in KVA shall be taken each month as the single highest thirty (30) minute integrated peak in KVA, as registered during the month by a demand meter or indicator, but the monthly demand so established shall in no event be less than the greater of (a) sixty (60) percent of the customer's contract capacity, or (b) sixty (60) percent of the customer's highest previously established monthly billing demand during the past eleven (11) months, or (c) one thousand (1,000) KVA. Thirty (30) minute periods where replacement electricity is supplied shall be excluded in the determination of the billing demand.

Billing energy shall be taken each month as the total KWH registered during the month by an energy meter, excluding energy purchased under the replacement electricity provision.

The metered voltage adjustment, as set forth below, shall not apply to the customer's minimum monthly billing demand.

Optional time-of-day provision: Available to customers who operate primarily during the off-peak period (as set forth below) and request the installation of time-of-day metering in order to receive service under this provision. The customer shall be required to pay the necessary additional metering cost.

For the purpose of this provision, the monthly billing demand as defined above shall be determined during the on-peak period. The off-peak excess demand shall be the amount by which the demand created during the off-peak period exceeds the monthly billing demand.

The on-peak billing period is defined as 7:00 a.m. to 7:00 p.m. local time for all weekdays, Monday through Thursday and 7:00 a.m. to 5:00 p.m. on Friday. The off-peak period shall be the time between 7:00 p.m. of each week day and 7:00 a.m. of the following day, between 5:00 p.m. on Friday and 7:00 a.m. of the following Monday and all day of New Year's Day, President's Day, Memorial Day, Independence Day, Labor Day, Thankgiving Day, the Friday after Thanksgiving Day, the day before Christmas Day and Christmas Day. The hours of the off-pak period above defined shall be subject to change from time to time at the city's option, provided that the week day off-peak perio hl not be reduced to less than eight (8) hours. On-peak hors are all hours not defined as off-peak hours.

At the request of a customer whose measured demand during off-peak hours normally exceeds measured demand during on-peak hours, the city will install metering equipment to determine the measured demand during both on-peak and off-peak hours. The total installed cost of such metering equipment in excess of the cost of the metering equipment that is necessary to determine a consumers single highest measured demand during the monthwill be paid for by the customer.

Metered voltage adjustment: The rates set forth in this schedule are based upon the delivery and measurement of energy at the same voltage, thus measurement will be made at or compensated to the delivery voltage. At the sole discretion of the city, such compensation may be achieved through the use of loss compensating equipment, the use of formulas to calculate losses or the application of multipliers to the metered quantities. In such cases the metered KWH and KVA values will be adjusted for billing purposes. If the city elects to adjust KWH and KVA based on multipliers, the adjustment shall be in accordance with the following:

(a) Measurements taken at the low-side of customer-owned transformer will be multiplied by 1.01.

(b) Measurements taken at the high-side of a city-owned transformer will be multiplied by 0.98.

Special terms and conditions: This schedule is subject to the city's terms and conditions of service.

A customer's plant is considered as one or more buildings which are served by a single electrical distribution system provided and operated by customer. When the size of the customer's load necessitates the delivery of energy to the customer's plant over more than one circuit, the city may elect to connect its circuits to different points on the customer's system irrespective of contrary provision in the terms and conditions. 1163.078 Large commercial and industrial electrical service, Schedule "LCI-T".

Availability: Available for industrial use from city's transmission system to customers establishing maximum demands generally in excess of 3000 kilovolt-amperes.

Type of service: Alternating current, 60 hertz, 3 phase, delivered from the city's transmission system at nominal, unregulated transmission voltage existing in the area.

Delayed Payment Charge: The above tariff is net if account is paid within 15 days of the date of bill. On all accounts not so paid, an additional charge of five percent (5%) of the total amount billed, but not less than one dollar ($1.00) will be charged.

Determination of Maximum Demand: The maximum demand shall be the sum of the individual demands of each metered service supplied under the provisions of this schedule.

The individual demand of each metered service shall be determined either as the measured demand or as estimated demand derived from the connected loads.

At the request of a consumer whose measured demand during Off-Peak Hours normally exceeds measured demand during On-Peak Hours, the City will install metering equipment to determine the measured demand during both On-Peak and Off-Peak Hours. The total installed cost of such metering equipment in excess of the cost of the metering equipment that is necessary to determine a consumer's single highest measured demand during the month will be paid for by the consumer.

For those consumers whose Measured Demand is determined during both On-Peak and Off-Peak Hours, Maximum Demand in any month shall be the greater of:

(a) the Measured Demand during On-Peak Hours of the current month; or

(b) the minimum billing demand, if any, specified in the service contract; or

(c) 3,000 KW.

For all other consumers, all hours are considered as On-Peak Hours.

Excess Demand: The Excess Demand in any month shall be the amount by which the Measured Demand during Off-Peak Hours of the current month exceeds the Maximum Demand for the month.

Consumer Transformation and Service Facilities: All transformation and service facilities, necessary to provide for the utilization of Primary Voltage service delivered to the consumer's premises at the nominal line voltage specified in the service contract, shall be provided by the consumer. Such facilities shall include (but shall not be limited to) suitable structures, line voltage bus, transformers, switchgear, protective devices, voltage regulators, etc., required to receive, transform and deliver service to the consumer's utilization equipment. All such facilities shall be installed in accordance with reasonable standards and if not so installed and maintained the City may refuse to deliver service to the consumer's facilities and premises.

Service and Contract Provisions: Only one supply service will be provided to a consumer under this Schedule at one Contract Location.

Each separate point of delivery of service shall be considered a Contract Location and shall be metered and billed under a separate service contract.

Term of Contract: Unless otherwise provided, the term of contract for service under this Schedule shall not be less than one (1) year. (Ord. 972-94.)

 

 

 

SECTION 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
