Explanation
 
BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a contract for the installation of a street lighting system with underground wiring under the assessment procedure.  Property owners have submitted a petition for a high-pressure sodium street lighting system with ornamental poles and underground wiring for the Berwick II and Berwick III areas. This legislation also authorizes the transfer of funds from the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund into the Street Lighting Assessment Fund for the City's share in the cost of installing the street lighting systems.  This legislation also amends the 2004 Capital Improvements Budget to reflect the transfers.
 
The Berwick II assessment area includes:  Beverly Place, Brookwood Road, Kingslea Road, Lakewood Road, Medford Road, Medford Place, Berwick Boulevard from Castlegate Road to Dover Road, Brookwood Place from Brookwood Road to and including parcel number 010-132086, Cassingham Road from Livingston Avenue to College Avenue, Dover Road from Cassingham Road to Brookwood Road, Euclaire Avenue from Livingston Avenue to College Avenue, Haddon Road from Kenwick Road to and including parcel number 010-101706, Kenwick Road from Livingston Avenue to Dover Road, Roosevelt Avenue from Livingston Avenue to Scottwood Road, and Sherbrooke Place from Scottwood Road to Berwick Boulevard.
 
The Berwick III assessment area includes:  Belmar Road, Castlewood Road, Clermont Road from Castlewood Road to James Road, Cottingham Court East, Cottingham Court West, Dover Road from Kenwick Road to James Road, Kenwick Road from Dover Road to Scottwood Road, Millerdale Road, Severn Road, Tudor Road, Wakefield Court East, Wakefield Court West, Wellesley Road and Wilmore Drive.
 
Resolution Number 111X-03, adopted June 2, 2003, authorized the preparation of plans and specifications; emergency legislation of necessity, Resolution Number 091X-2004, was adopted April 19, 2004; and Ordinance Number 2027-2004, determining to proceed, was passed November 22, 2004 for Berwick II.
 
Resolution Number 255X-03, adopted July 7, 2003, authorized the preparation of plans and specifications; emergency legislation of necessity, Resolution Number 090X-2004, was adopted April 19, 2004; and Ordinance Number 2029-2004, determining to proceed, was passed November 22, 2004 for Berwick III.
 
Three bids were received and opened by the Director of Public Utilities on February 16, 2005.  The Division of Electricity recommends an award to Jess Howard Electric Company, in the amount of $890,061.67, as the lowest responsive and responsible bid received.  Their Contract Compliance Number is 314405752.

Emergency action is requested due to citizens' approved petition for a timely implementation of construction services.
 
FISCAL IMPACT:  The determined amount to be paid for the City's share under the Berwick Phase II assessment procedure is $155,000.  Additional funding in the amount of $167,000 will be made available from the Urban Infrastructure Recovery Fund.
 
The determined amount to be paid for the City's share under the Berwick Phase III assessment procedure is $112,000.  Additional funding in the amount of $145,800 will be made available from the Urban Infrastructure Recovery Fund.
 
Funds for the Division of Electricity's share are being transferred within the Street Lighting and Distribution System Improvements Fund from capital projects that are being deferred to later dates.

WHEREAS, Jess Howard Electric Company submitted the lowest responsive and responsible bid opened by the Director of Public Utilities on February 16, 2005 for the installation of the aforesaid street lighting system; and
 
WHEREAS, funding is necessary to pay for construction costs, design, construction inspection, engineering, advertising and printing, and any other miscellaneous expenses for said project; and
 
WHEREAS, it is necessary to transfer funds from the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund into the Street Lighting Assessment Fund to provide for the City's share in the cost of installing a street lighting system with underground wiring in the Berwick II and Berwick III areas under the assessment procedure; and
 
WHEREAS, it is necessary to amend the 2004 Capital Improvements Budget to reflect the aforementioned transfers; and
 
WHEREAS, emergency action is required in order to complete financial transactions and enter into contract to comply with citizens' approved petition for timely implementation of construction services; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Electricity, in that it is immediately necessary to enter into a contract for labor and material for the construction of street lighting improvements for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the 2004 Capital Improvements Budget is hereby amended as follows:

SECTION 4.  That the City Auditor is hereby authorized to appropriate $322,000.00 in the Berwick II Area Street Lighting Assessment Project, Fund No. 580, Subfund 981, OCA 580981, Object Level Three 6625.
 
SECTION 5.  That the City Auditor is hereby authorized to appropriate $257,800.00 in the Berwick III Area Street Lighting Assessment Project, Fund No. 580, Subfund 982, OCA 580982, Object Level Three 6625.
 
SECTION 6.  That the Director of Public Utilities is hereby authorized to enter into a contract with Jess Howard Electric Company, in the amount of $890,061.67, and to obtain and pay for the services of the Division of Electricity, the Transportation Division, and any services of other City divisions as may be necessary to complete the street lighting systems for the Berwick II and Berwick III areas.
 
SECTION 7.  That to pay the cost of the aforesaid contract and expenses, the expenditure of $1,122,800.00, or so much thereof as may be needed, be and is hereby authorized from Division of Electricity, Division No. 60-07, Fund No. 580, as follows:
