CITY DEPARTMENTS' RECOMMENDATION:  Approval.  Applicant's request is consistent with land uses allowed to the north, east and west across West Broad Street.  The limitation text establishes appropriate use restrictions and development standards addressing lighting, landscaping and necessary traffic improvements.

WHEREAS, application #Z02-061 is on file with the Building Services Division of the Department of Development requesting rezoning of 13.94± acres from R, Rural District, to L-C-4, Limited Commercial District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the Greater Hilltop Area Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because Applicant's request is consistent with land uses allowed to the north, east and west across West Broad Street.  The limitation text establishes appropriate use restrictions and development standards addressing lighting, landscaping and necessary traffic improvements; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
 
      2 GEORGESVILLE ROAD (43228), being 13.94± acres located at the southeast corner of Georgesville Road and West Broad Street, and being more particularly described as follows:
 
Annexation description of 13.944 acres at West Broad St. and Georgesville Rd.
 
Situated in the State of Ohio, County of Franklin, Township of Franklin, and being a part of Virginia Military Survey Number 1482, and being 13.944 acres out of a 147.973 acre tract as conveyed to Delphi Automotive Systems LLC as recorded in Instrument No. 199902010025133, Franklin County Recorder's Office, said 13.944 acre tract being further described as follows:
 
Beginning for reference at a point, said point being the intersection of the centerlines of Georgesville Rd. (110' wide) and West Broad St (U.S. Route 40, 160' wide), said point being the northwest corner of said 147.973 acre tract;
 
Thence North 88 degrees 02'00" East 123.52 feet, along the centerline of said West Broad St. being the north line of said 147.973 acre tract, to a point;
 
Thence South 01 degrees 58' 00" East 90.00 feet, crossing said 147.973 acre tract, to a point on the south line of said West Broad St., said point being the True Place of Beginning for the herein described 13.944 acre tract;

Bearings used for the determination of angles only. For the purposes of this description bearings are referenced to the centerline of West Broad St. as being North 88 degrees 02' 00" East, as shown on a survey performed by EMH&T dated March 22, 2001. Section 2.  That a Height District of Sixty (60) feet is hereby established on the L-C-4, Limited Commercial District on this property.
 
Section 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved L-C-4, Limited Commercial District and Application among the records of the Building Services Division as required by Section 3370.03 of the Columbus City Codes; said text being titled, " LIMITATION TEXT," signed by Jeffrey L. 1.      INTRODUCTION: The site is located at the southeast corner of Georgesville Road and West Broad Street.
 
2.      PERMITTED USES: Those uses permitted under Section 3355.02 C-4 commercial of the Columbus City Code with the following exclusions:
 
1.      Armory
2.      Bar
3.              Beer/Wine drive thru
4.      Billboards
5.      Dance hall
6.      Electric substation
7.      Funeral parlor
8.      Millinery
9.      Motor bus terminal
10.      Night club/cabaret
11.      Pool room
12.      Poultry killing (not to exclude a poultry shop where killing        is not performed on site)
13.      Tinsmith
14.      Trade School
15.      Stable
 
3.      DEVELOPMENT STANDARDS: Unless otherwise indicated in the written text, the applicable development standards shall be those standards contained in Chapter 3355, C-4, Commercial of the Columbus City Code.  
 
A.      Density, Height, Lot and/or Setback commitments.
 
1.  Height District shall be 60 feet as measured per Columbus City Code with a maximum height of 60 feet for a hotel/motel use and 45 feet for any other use.
 
2.  Parking setback from Georgesville Road and West Broad Street shall be ten (10) feet.
 
B.      Access, Loading, Parking and/or other Traffic related commitments.
 
      1.  All curbcuts and access points shall be subject to the approval of the appropriate governmental agency.
 
2.  The developer shall install at its own expense on West Broad Street an east bound right turn at the first driveway east of Georgesville Road, 125 feet in length with a 50 foot taper.
 
3.  The developer shall restripe Georgesville Road at its own expense to create a southbound left turn lane at the first driveway south of West Broad Street 50 feet in length with a 50 foot taper.  This driveway shall be full access unless the County Engineer determines that there is a problem with accidents at this driveway which results from turning movements.
 
C.      Buffering, Landscaping, Open space and/or Screening commitments.
 
1.  Within the setback areas along Georgesville Road and West Broad Street, one tree per thirty (30) linear feet shall be installed.  The trees may be evenly spaced or grouped together.
 
2.  Within the parking setback area along West Broad Street and Georgesville Road a thirty (30) inches average height continuous (except at access points) planting hedge, fencing wall, earth mound individually or in any combination thereof shall be installed in said areas.  If the West Broad Street frontage area between the existing driveway for the automobile plant and the east property line is acquired by the automobile dealership to the east and incorporated into that dealership's site, then the 30 inches screening requirement shall not be required along this portion of the West Broad Street frontage.
 
3.  All trees and landscaping shall be well maintained.  Dead items shall be replaced within six (6) months with landscape materials per the original requirements.
 
4.  One tree shall be planted for every ten (10) parking spaces which shall count toward satisfying the interior tree requirement of Chapter 3342 of the Columbus City Code.  
 
5.  Minimum tree sizes at installation: deciduous trees, 2 ½" inch caliper; ornamental trees 1 ½" inch caliper; evergreen, five (5) feet in height.
 
D.          Building design and/or Interior-Exterior treatment commitments.

E.          Dumpsters, Lighting, Outdoor display areas and/or other environmental commitments.
 
1.  All non-decorative lighting shall be down lighting (cut off fixtures).
 
2.  All external outdoor lighting fixtures within a given area shall be from the same or similar manufacturer's type to insure compatibility.
 
3.  Parking lot lighting standards shall not exceed twenty-eight (28) feet in height.
 
4.  In parking lots, lights shall be placed in raised islands or medians to protect both lights and vehicles from damage.
 
5.  Wiring within a development shall be underground.
 
6.  The developer shall install sidewalks along its frontage on both Georgesville Road and West Broad Street.
 
7.  Dumpsters shall be screened on three sides with a fence, wall, building or landscaping to a height of six (6) feet with a gate on the fourth side.
 
F.      Graphics and Signage commitments.
 
1.  All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code as it applies to the C-4 Commercial District and any variance to the sign requirements shall be submitted to the Columbus Graphics Commission for consideration.
 
G.      Miscellaneous commitments.
 
1.  The developer shall comply with the park land dedication ordinance by donating $400/acre to the Recreation and Parks Department.
 
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
