Explanation
BACKGROUND:
This legislation will authorize the Director of the Department of Technology (DoT) to enter into a software purchase, installation & support agreement with VERITAS Software Global Corporation (VERITAS). The City has a critical need to maintain the integrity and support of city business operation systems, provide information backup and system recovery services, and provide the foundation for future disaster recovery capabilities. The new agreement is targeted to address two goals contained in The Columbus Covenant, Customer Service and Peak Performance.
The VERITAS software system has been employed within multiple City agencies. Thus establishing a base of technical expertise in the execution and use of VERITAS' product, which will expedite the implementation and utilization of a software tool that performs daily backups of all City agencies' information systems.
The Department of Technology has gained extensive knowledge concerning the VERITAS product and has researched that there is a limited market for enterprise backup software. This research has been confirmed through the Gartner Group, an independent Information Technology research firm. Also, VERITAS is known as an industry leader in information systems backup and recovery software and currently commands more than one-half of the entire market for this type of product. In order to maintain daily business operations, it is in the City's best interest to waive the competitive bidding provisions of the Columbus City Code.
FISCAL IMPACT:
Price negotiations with Veritas have led to aggressive price discounts and will result in significantly reduced operating costs. Funding is available in the Information Services Capital Improvement Fund for this purchase. An $110,631.00 encumbrance in the Site License Capital Project will be cancelled since it is no longer need. Funds from this encumbrance will be transferred to the Disaster Recovery Project. This ordinance amends the 2002 Capital Improvement Budget to reflect these changes. This contract shall not exceed $313,982.00.
EMERGENCY:
Emergency legislation is requested in order to facilitate immediate purchase and implementation of software from the supplier.

WHEREAS, this legislation will authorize the Director of the Department of Technology (DoT) to enter into a Software Purchase, Installation & Support Agreement with VERITAS Software Global Corporation (VERITAS) and to expend $313,982.00 for the period of October 15, 2003 through October 14, 2004; and
WHEREAS, the City has a need to procure new network software, to provide information backup and system recovery services and provide the foundation for future disaster recovery capabilities; and
WHEREAS, the new agreement is targeted to address two goals contained in The Columbus Covenant, Customer Service and Peak Performance; and
WHEREAS, the VERITAS software system has been employed within multiple City agencies; thereby, establishing a base of technical expertise in the execution and use of VERITAS' product; and
WHEREAS, this expertise will expedite the implementation and utilization of a software tool that performs daily backup of all City agencies' information systems; and
WHEREAS, the Department of Technology has gained extensive knowledge concerning the VERITAS product and has researched that there is a limited market for enterprise backup software products; and
WHEREAS, this research has been confirmed through the Gartner Group, an independent Information Technology research firm; and
WHEREAS, it is necessary to amend the 2002 Capital Improvement Budget to allow for this expenditure; and
WHEREAS, in order to maintain daily business operations, it is in the City's best interest to waive the competitive bidding provisions of the Columbus City Code; and
WHEREAS, an emergency exists in the usual daily operation of the City in that it is immediately necessary to authorize this purchase order, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1: That the Director of the Department of Technology be and is hereby authorized to enter into contract with VERITAS Software Global Corporation for the purchase of NetBackup (NBU) software, installation, training and support services in an amount not to exceed $313,982.00.
SECTION 2: To authorize the transfer between projects within the Information Services Capital Improvement Fund Number 514, Subfund 002 as follow:

SECTION 5: That this agreement is made in accordance with the Bid Waiver provisions of Section 329.07( c ) of the Columbus City Code.
SECTION 6: That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
