BACKGROUND: Ordinance No. 1870-2014, passed September 8, 2014, authorized the Director of the Department of Public Service to modify a design agreement with Norfolk Southern Railroad for the Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee (FRA-CR122-6.22 (PID 85017)) project ("Project") for an amount up to $22,500.00.
It has since been determined that the project name in the Title and Body of said ordinance is incorrect.
This ordinance amends 1870-2014 to correct the project name from Arterial Street Rehabilitation - Lockbourne Rd - Frebis Rd - SR 104 (PID 530103) to Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee (FRA-CR122-6.22 (PID 85017)).
FISCAL IMPACT: No additional funds are required for this amendment.
EMERGENCY DESIGNATION: Emergency action is requested to provide necessary engineering and design funding and prevent unnecessary delays in the Department of Public Service's Capital Improvement Program.

WHEREAS, on September 8, 2014, Columbus City Council passed Ordinance No. 1870-2014, authorizing the Director of the Department of Public Service to modify a design agreement with Norfolk Southern Railroad for the Arterial Street Rehabilitation - Lockbourne Rd - Frebis Rd - SR 104 (PID 530103)) project ("Project") for an amount up to $22,500.00; and
WHEREAS, it has since been determined that the project name in the Title and Body of said ordinance is incorrect; and
WHEREAS, the correct project name is Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee (FRA-CR122-6.22 (PID 85017)); and
WHEREAS, this ordinance amends 1870-2014 to correct the project name to Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee (FRA-CR122-6.22 (PID 85017)); and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to amend Ordinance No. 1870-2014 to prevent unnecessary delays in the Department of Public Service's Capital Improvement Program which will preserve the public peace, property, health, safety, and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Title of Ordinance No. 1870-2014 shall be amended to read as follows:
To authorize the Director of the Department of Public Service to modify a design agreement with the
Norfolk Southern Railway Company, a Virginia corporation, for continued review of plans and associated work pertaining to the Arterial Street Rehabilitation - Lockbourne Rd - Frebis Rd - SR 104 (PID 530103) project Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee (FRA-CR122-6.22 (PID 85017)) project; to authorize the expenditure of up to $22,500.00 from the Streets and Highways Bonds Fund; and to declare an emergency. ($22,500.00)
SECTION 2: That the Body of Ordinance No. 1870-2014 shall be amended to read as follows:
WHEREAS, the City of Columbus, Ohio, Department of Public Service is engaged in the Arterial Street Rehabilitation - Lockbourne Rd - Frebis Rd - SR 104 (PID 530103) Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee (FRA-CR122-6.22 (PID 85017)) project ("Project"), which the Project crosses over real property owned by the Norfolk Southern Railway Company ("NSRC"), Virginia corporation; and
SECTION 3. That Section 1 of Ordinance No. 1870-2014 shall be amended to read as follows:
The Director of the Department of Public Service is authorized to modify a design agreement with the Norfolk Southern Railway Company ("NSRC"), a Virginia corporation, for the purpose of authorizing NSRC to continue to review plans and perform other work pertaining to the Arterial Street Rehabilitation - Lockbourne Rd - Frebis Rd - SR 104 (PID 530103) Project. Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee (FRA-CR122-6.22 (PID 85017)) project.
SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
