Explanation
 
1.  BACKGROUND:
Council, by its Ordinance No. 2117-2005 passed on December 12, 2005, approved the creation of ten tax increment financing districts to provide funding for public infrastructure improvements in the northeast area of the City.  That legislation provides that the owners of relevant real property are required to make payments in lieu of real property taxes which are to be distributed to relevant school districts and to designated tax increment equivalent funds.  Payments in lieu of taxes that are deposited into the tax increment equivalent funds are to be used at the direction of the City for the purpose of funding the public infrastructure improvements identified in the legislation.  Two projects, under one contract, to be funded from these TIF funds are Roadway Improvements - Warner Road Phase 1 and Traffic Signal Installation - Hamilton Road at Warner Road.     
 
This legislation authorizes the Director of Public Service to enter into a contract for the construction of the Roadway Improvements - Warner Road Phase 1 & Traffic Signal Installation - Hamilton Road at Warner Road projects and to provide for the payment of construction administration and inspection services.  
 
Work on these projects consists of widening Warner Road and adding a turn signal at Hamilton Road at Warner Road.  Warner Road will be widened from about 770 feet from the centerline of Ulry Road to a point located at 3,657 feet east.  A five foot wide sidewalk along the North side of the road and an eight foot wide shared use path along the South side of the road will be constructed as part of this project.  This project is comprised of 16 ADA curb ramps, 0.69 miles of a five foot wide sidewalk, an eight foot wide shared use path, 1.4 miles of curbing, storm sewers, and landscaping.  Along with the installation of a traffic signal at Hamilton Road at Warner Road, two ADA curb ramps and about 160 feet of a five foot wide foot sidewalk will also be constructed.
 
The estimated Notice to Proceed date is March 20, 2013.  The project was let by the Office of Support Services through Vendor Services and Bid Express.  Eight bids were received on January 22, 2013, (eight majority) and tabulated on January 23, 2013, as follows:

Award is to be made to the lowest responsive and responsible and best bidder, Trucco Construction Company for their bid of $2,567,701.45.  
 
Searches in the System for Award Management List (Federal) and the Findings for Recovery list (State) produced no findings against Trucco Construction Company.  
 
2.  CONTRACT COMPLIANCE
The contract compliance number for Trucco Construction Company is 311293605 and expires 6/12/14.
 
3.  FISCAL IMPACT
Funding for this contract in the amount of $824,471.60 is available and will be funded from the Albany Crossing TIF Fund, number 441, and $2,000,000.00 is available and will be funded from the Upper Albany West TIF, number 443.
 
4. EMERGENCY DESIGNATION.
Emergency action is requested in order for this project to commence as early as possible in order to perform necessary construction for the completion of the project during the construction season, to make this shared use path available to pedestrians as early as possible, and to provide for the safety of the travelling public.

WHEREAS, the Department of Public Service is engaged in the Roadway Improvements - Warner Road Phase 1 & Traffic Signal Installation - Hamilton Road at Warner Road projects in the northeast area of the City; and

WHEREAS, funding for this contract will by provided by TIF funds from the TIF incentive districts in the northeast area of Columbus authorized by Ordinance 2117-2005; and
 
WHEREAS, bids were received on January 22, 2013, and tabulated on January 23, 2013, for the Roadway Improvements - Warner Road Phase 1 and Traffic Signal Installation - Hamilton Road at Warner Road projects and a satisfactory bid has been received; and
 
WHEREAS, it is necessary to provide for construction administration and inspection costs; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that the funding should be authorized immediately to perform necessary improvements for the economic growth of this area, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Service be and is hereby authorized to enter into a contract with Trucco Construction Company, 3531 Airport Road,  Delaware, Ohio, 43015 for the construction of  the Roadway Improvements - Warner Road Phase 1 & Traffic Signal Installation - Hamilton Road at Warner Road projects in the amount of up to $2,567,701.45 or so much thereof as may be needed, for the Division of Design and Construction in accordance with the specifications and plans on file in the Office of Support Services, which are hereby approved; and to obtain and pay for the necessary inspection costs associated with the project up to a maximum of $256,770.15.
 
SECTION 2. The sum of $2,824,471.60 be and is hereby appropriated from the unappropriated balance of the Albany Crossing TIF Fund, Fund 441 and the Upper Albany West TIF, number 443, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2013, as follows:

SECTION 3.   That the sum of up to $2,824,471.60 is authorized to be expended for this contract as follows:

SECTION 4  That the funds necessary to carry out the purpose of this Ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 5.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
 
SECTION 6.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
