Explanation
Background: This legislation authorizes the Public Service Director to enter into a professional services contract for the Facilities Management Division with Dynamix Engineering Ltd., CC No. 31-1536631, exp. 06/27/2005, for professional engineering services associated with the renovation of HVAC systems, direct digital controls, and fire alarm systems at 750 Piedmont Avenue. The Piedmont Avenue building has four HVAC systems. Currently, all four systems have refrigerant leaks. Approximately half of these leaks are serious, violating environmental protection laws. Furthermore, all four systems are piped incorrectly, leading to compressor burnouts, therefore costing the Facilities Management Division substantial amounts of money in repairs. The control system is obsolete and minimally operable. The fire alarm system does not meet current local building codes, the system is not expandable, and the wiring is antiquated.
Dynamix Engineering Ltd. will be responsible for the complete design program including, but not limited to: architectural design, structural engineering, mechanical and electrical engineering, cost estimating, civil engineering, construction observation, shop drawing review, off site and on site utilities, site work and drawings for City's approval, razing of existing equipment, all master plans and meetings, design/development, specifications and drawings of all phases, assisting in the bidding process, recommendation letters, submittals, construction administration, change orders, schedules, budgeting, close out of project, new plumbing, mechanical, electrical and HVAC, fire alarms, all engineering and architectural work to complete this project, and other services required for the completion of the project. The Piedmont Avenue building shall conform to the energy code, Green Light/Green Star, OSHA and ADA requirements.
Formal proposals were solicited in the City Bulletin and submitted to the Facilities Management Division on June 17, 2004. Ten firms submitted proposals. The proposals were formally evaluated by a five-member evaluation committee on August 4, 2004. Dynamix Engineering Ltd. received the highest overall score.
Emergency action is requested so that work may begin as quickly as possible to bring the HVAC systems and fire alarm system up to Code.
Fiscal Impact: The Facilities Management Division budgeted $945,000 in the 2004 Capital Improvements Budget for the renovation of the Piedmont Avenue building HVAC and Fire Alarm systems. The actual project renovations will be bid once the engineering services are complete. The total cost of this professional engineering services contract is $90,000.00

WHEREAS, the HVAC systems, direct digital controls, and fire alarm systems at 750 Piedmont Avenue are in disrepair, thereby causing the leakage of refrigerant in violation of environmental protection laws and costing the Facilities Management Division money in repairs, and
WHEREAS, it is necessary to contract with a professional engineer in order to design new HVAC systems, direct digital controls, and a fire alarm system at 750 Piedmont Avenue, and
WHEREAS, ten firms submitted proposals for this project and Dynamix Engineering Ltd., achieved the highest overall score from a five-person evaluation committee, and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Facilities Management Division, in that it is immediately necessary to authorize the Public Service Director to contract with Dynamix Engineering Ltd. for professional services associated with the renovation of HVAC systems, direct digital controls, and fire alarm system at 750 Piedmont Avenue, so that there is no delay in this project or violations of building codes, thereby preserving the public health, peace, property, safety and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director is hereby authorized to contract with Dynamix Engineering Ltd. for professional services associated with the renovation of HVAC systems, direct digital controls, and fire alarm system at 750 Piedmont Avenue.
SECTION 2. That the expenditure of $90,000.00, or so much thereof that may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the mayor neither approves or vetoes the same.
