Explanation

1. BACKGROUND

This ordinance authorizes the Director of the Department of Finance and Management to enter into contract with Ohio Traffic and Lighting Solutions, Inc. for the purchase of traffic signal supports and to issue purchase orders as necessary for the purchase of the traffic signal supports on behalf of the Department of Public Service, Division of Traffic Management.  The Division of Traffic Management will use the traffic signal supports in association with the Intersection - Cleveland Ave at Myrtle Ave project.

 

The Department of Public Service is in the process of bidding the construction portion for the Intersection - Cleveland Ave at Myrtle Ave project.  In an effort to ensure these projects are completed on-time, Public Service is requesting to waive bidding provisions of City Code Chapter 329, enter directly into contract with Ohio Traffic and Lighting Solutions, Inc., and to establish a purchase order with Ohio Traffic and Lighting Solutions, Inc. to purchase the traffic signal supports.  The lead time on these commodities can be up to six (6) months from order and would cause delays in the construction.

 

2. CONTRACT COMPLIANCE

Ohio Traffic and Lighting Solutions, Inc. contract compliance number is CC026399 and expires 10/16/2025.

 

3. FISCAL IMPACT

Funds are available and appropriated within the Municipal Motor Vehicle Tax Fund, Fund 2266. 

 

4. EMERGENCY DESIGNATION

Emergency action is requested to ensure the signal supports are received as soon as possible so that the project is completed on time.

Body

WHEREAS, the Department of Public Service is in the process of starting the bidding for the construction portion for Intersection - Cleveland Ave at Myrtle Ave project; and

 

WHEREAS, to ensure this phase of the project is completed on-time, Public Service will need to secure the traffic signal supports required for the project; and

 

WHEREAS, it is in the City's best interests to waive the competitive bidding provisions of City Codes Chapter 329 for purchases from Ohio Traffic and Lighting Solutions, Inc. because of the required lead time for products to be received; and

 

WHEREAS, it has become necessary in the usual daily operation in the Department of Public Service to authorize the Director of Finance and Management to enter into contract and issue purchase orders with Ohio Traffic and Lighting Solutions, Inc.; and

 

WHEREAS, funding is available for this purchase in the Municipal Motor Vehicle Tax Fund; and

 

WHEREAS, it is necessary to expend funds to pay for the traffic signal supports; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Traffic Management, in that it is immediately necessary to authorize the Director of the Department of Finance and Management to establish purchase orders with Ohio Traffic and Lighting Solutions, Inc. for these traffic commodities as soon as possible to ensure the project is completed on time, all for the immediate preservation of the public health, peace, property, and safety; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of the Department of Finance and Management is hereby authorized to enter into contract and establish purchase orders with Ohio Traffic and Lighting Solutions, Inc. for the purchase of traffic signal supports for the Department of Public Service, Division of Traffic Management.

                     

SECTION 2. That this Council finds it in the City’s best interest to waive the competitive bidding provisions of Columbus City Codes Chapter 329.

 

SECTION 3. That the expenditure of $61,747.00, or so much thereof as may be needed, is hereby authorized in Fund 2266 (Municipal Motor Vehicle Tax Fund), Dept-Div 5913 (Traffic Management), Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 4.  That funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 6.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 7. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
