BACKGROUND: This contract provides for Distribution Improvements - Pressure Regulating Valve Installations on Olentangy River Road. Competitive bids were received and opened for this project at the office of the Director of Public Utilities on November 3, 2004. One (1) bid was received on this project. A responsive bid was submitted by Affordable Choice Electric Inc., 1464 Delashmut Avenue, Columbus, Ohio, 43212. Contract to be awarded to same.
CONTRACT COMPLIANCE NUMBER: 31-1461454
FISCAL IMPACT: The 2004 C.I.B. is being amended and funds are being transferred to provide the monies needed for this project.
This ordinance is submitted as an emergency so as to allow the earliest possible start of construction.

WHEREAS, the Director of Public Utilities did receive and open bids on November 3, 2004, for Distribution Improvements Pressure Regulating Valve Installations on Olentangy River Road, and
WHEREAS, a responsive and responsible bid has been received, and
WHEREAS, an emergency exists in the usual daily operations of the Division of Water, Department of Public Utilities in that it is immediately necessary to authorize the Director of Public Utilities to enter into a contract for Distribution Improvements Pressure Regulating Valve Installations on Olentangy River Road for the Division of Water so as to allow the earliest possible start of construction, for the preservation of public health, peace, property, safety and welfare; Now, Therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities is hereby authorized to enter into a contract with Affordable Choice Electric Inc., 1464 Delashmut Avenue, Columbus, Ohio, 43212, in the amount of $331,823.80 for construction of Pressure Regulating Valve Installations on Olentangy River Road for the Division of Water, Department of Public Utilities, Contract No. 1069, Project No. 690290, on the basis of the most responsive and responsible bid received on November 3, 2004.
Section 2. That the City Auditor is hereby authorized and directed to transfer funds within the Waterworks Enlargement Voted 1991 Bonds Fund, Fund No. 606, Department of Public Utilities, Division of Water, as follows:

Section 3. That for paying the cost of construction, the expenditure of $331,823.80 or as much thereof as may be needed be, and the same is hereby authorized from the Water Works Enlargement Voted 1991 Bonds Fund No. 606, Department 60, Division 09, OCA Code 642900, Object Level Three Code 6621, Object Level One 06, Project No. 690290.
Section 4. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund, upon receipt of certification by the Director of the department administering said project; that the project has been completed and the monies are no longer required for said project, except that no transfer shall be so made from a project funded by monies from more than one source.
Section 5. That Section 1, Public Utilities/Water 60-09 of Ordinance 1059-2004 is hereby amended as follows:

Section 6. That for the reasons stated in the preamble hereto, which is hereby made a part thereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage, if the Mayor neither approves nor vetoes the same.
