Title: To authorize the Public Service Director to execute those documents required to release the easterly 5 feet of an existing platted easement on Lot 27 of Asherton Woods (of record in Plat Book 102, Pages 94 and 95) in exchange for the dedication of a 5 foot wide easement along the east line of Reserve "A" of the same plat.
Explanation
 
The Public Service Department, Transportation Division, recently received a request from Anthony Williams, on behalf of M/I Schottenstein Homes, Inc., asking that the City release the easterly 5 feet of an existing platted easement on Lot 27 of Asherton Woods (of record in Plat Book 102, Pages 94 and 95) in exchange for the dedication of a 5 foot wide easement along the east line of Reserve "A" of the same plat.  The release of the requested portion of this platted easement will allow for a larger building lot that will accommodate a dwelling comparable to those planned for the neighboring lots.  After investigation it has been determined there are no utilities currently located within this easement and that the release of the requested portion of the platted easement in exchange for a replacement easement will not adversely affect future utility services to the subdivision.  A value of $500.00 has been established for the release of this easement.
 
The City will receive a total of $500.00, to be deposited in Fund 748, Project 537650, as consideration for the release of the requested portion of this platted easement in exchange for a replacement easement.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request from Anthony Williams, on behalf of M/I Schottenstein Homes, Inc., asking that the City release the easterly 5 feet of an existing platted easement on Lot 27 of Asherton Woods (of record in Plat Book 102, Pages 94 and 95) in exchange for the dedication of a 5 foot wide easement along the east line of Reserve "A" of the same plat; and
 
WHEREAS, the release of the requested portion of this platted easement will allow for a larger building lot that will accommodate a dwelling comparable to those planned for the neighboring lots; and
 
WHEREAS, after investigation it has been determined there are no utilities currently located within this easement and that the release of the requested portion of the platted easement in exchange for a replacement easement will not adversely affect future utility services to the subdivision; and
 
WHEREAS, a value of $500.00 has been established for the release of the requested portion of this easement in exchange for a replacement easement; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Public Service Director be and is hereby authorized to execute those documents necessary to release the following described portion of a platted easement to M/I Schottenstein Homes, Inc.; to-wit:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, located in Quarter Township 2, Township 1, Range 17, United States Military Lands and being the easterly 5.00 feet of an existing 10 foot easement along the westerly line of Lot 27 of that subdivision entitled "Asherton Woods" of record in Plat Book 102, Page 94 (all records refer to the records of the Recorder's Office, Franklin County, Ohio) and being more particularly described as follows:
Beginning, for reference, at the northwesterly corner of said Lot 27 of Asherton Woods, said corner being in the southerly right-of-way line of Lifestyle Boulevard;
Thence with an arc of a curve to the right, having a central angle of 05°45'20", a radius of 50.00 feet, a chord bearing and distance of North 88°23'37" East, 5.02 feet to the True Point of Beginning;
Thence continuing with said arc of a curve to the right, having a central angle of 02°18'28", a radius of 50.00 feet, a chord bearing and distance of South 87°34'30" East, 2.01 feet to a point of tangency;
Thence South 86°25'16" East, continuing with said southerly right-of-way line, a distance of 2.99 feet to a point;
Thence South 03°34'44" West, over said Lot 27, a distance of 120.00 feet to a point in the southerly line of said Lot 27;
Thence North 86°25'16" West, with said southerly line, a distance of 5.00 feet to a point;
Thence North 03°34'44" East, over said Lot 27, a distance of 119.96 feet to the True Point of Beginning, and containing 0.014 acre of land, more or less.

Section 2.  That in exchange for the release of the above described portion of the platted easement over Lot 27 of "Asherton Woods" M/I Schottenstein Homes, Inc., has agreed to deed the following described replacement easement to the City of Columbus, to-wit:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, located in Quarter Township 2, Township 1, Range 17, United States Military Lands and being an easement over Reserve "A" of that subdivision entitled "Asherton Woods" of record in Plat Book 102, Page 94 (all references refer to the records of the Recorder's Office, Franklin County, Ohio) and described as follows:
Beginning at the northeasterly corner of said Reserve "A", and the southerly right-of-way line of Lifestyle Boulevard;
Thence South 03°34'44" West, with an easterly line of said Reserve "A" a distance of 119.51 feet to a corner thereof;
Thence North 86°25'16" West, with a southerly line of said Reserve "A", a distance of 5.00 feet to a point;
Thence North 03°34'44" East, over said Reserve "A", a distance of 118.54 feet to a point on a curve in said southerly right-of-way line;
Thence with said southerly right-of-way line along a curve to the right (Delta = 05°50'21", Radius = 50.00 feet) a chord bearing and distance of North 82°35'46" East, 5.09 feet to the Point of Beginning and containing 0.014 acre of land, more or less.

Section 3.  That the $500.00 to be received by the City as consideration for the above referenced exchange shall be deposited in Fund 748, Project 537650.
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
