Explanation
Background: Ordinance 1941-2005 and 1887-2005 passed on December 5, 2005 authorized a special assessment upon the lots and lands in McDannald Estates and Willow Springs. Due to the late date of these approvals not all property owners were able to pay systems capacity fees prior to December 31, 2005. This ordinance requests approval to allow payment of systems capacity fees at the rate in effect prior to January 1, 2006, so long as those fees are paid prior to March 31, 2006. The legislation also requests approval to allow Danny Susi of 2523 McCutcheon Road to pay capacity fees at the rate in effect prior to January 1, 2006 so long as the fee is paid prior to March 31, 2006. Mr Susi suffered severe health problems that prevented payment of the fee prior to December 31. 2005.

To authorize the Director of Public Utilities to accept payment of systems capacity fees at the rate in effect prior to January 1, 2006 from property owners located in the McDannald Estates Area Sewer Assessment Project and the Willow Springs Area Sewer Assessment Project and from Danny Susi.

WHEREAS, Due to the late date of passage of authorizing legislation not all property owners located in the McDannald Estates and the Willow Springs Area Sewer Assessment Projects were able to pay required systems capacity fees prior to December 31, 2005, and
WHEREAS, Mr Danny Susi of 2523 McCutcheon Road was also unable to pay a capacity fee prior to December 31, 2005 due to severe health problems, and
WHEREAS, Since these projects and Mr Susi's application to connect to the city sewer were underway well before the capacity fee increase took place on January 1, 2006, and
WHEREAS, City Council finds it in the best interest of the City and these property owners to allow payment at the rate in effect prior to January 1, 2006, now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities is hereby authorized to accept payment of systems capacity fees for the lots and lands of the McDannald Estates Area Sewer Assessment Project and the Willow Springs Area Sewer Assessment Project and from Mr Danny Susi of 2523 McCutcheon Road at the capacity fee rates in effect on December 31, 2005 , so long as those fees are paid on or before March 31, 2006.
Section 2. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
