Explanation
 
BACKGROUND:
 
This legislation is to accept and appropriate FY 2006 Congressionally mandated award of $296,168, through the U.S Department of Justice.  The Office of Justice Programs, through the Bureau of Justice Assistance awarded these grants to the City of Columbus to bolster the Mayor's anti-gang initiative.  Through the Edward Byrne Memorial State and Local Law Enforcement Assistance Program (the Byrne Program), the Bureau of Justice Assistance (BJA) provides discreationary funds for crime and violence prevention and control activities to State and Local Governments.  The Mayor's anti-gang initiative involves the simultaneous implementation of law enforcement, neighborhood services and community/social services. Emergency legislation is required to establish the funds because of time line limitations.
 
FISCAL IMPACT:
 
This grant was awarded at 100 percent of the approved projects. There are no matching fund requirements. All funds are to be expended and/or encumbered by the end of the grant period, October 31, 2006.

WHEREAS, the City of Columbus has been granted a FY06 Congressionally mandated award; and
 
WHEREAS, this legislation seeks to direct the Mayor of the city of Columbus to accept this Byrne Memorial State and Local Law Enforcement Assistance from the U.S Department of Justice, Bureau of Justice Assistance; and
 
WHEREAS, these funds will be used to bolster the Mayor's anti-grant initiative by providing assistance to Law Enforcement, Neighborhood and Community/Social groups that combat gang activities; and
 
WHEREAS, an emergency exists in the daily operation of the Department of Public Safety, in that it is immediately necessary to authorize the Mayor to accept the FY 2006 Local Law Enforcement Assistance to bolster the city's anti-gang initiative, and to authorize an appropriation for the preservation of the public health, peace, proporty, safety and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Mayor of the City of Columbus be and is hereby authorized and directed to accept a FY06 Byrne Local Law Enforcement Assistance to support the City's anti-gang initiative.
 
Section 2. That from the unappropriated monies in the General Government Grant Funds and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purposes during the grant award period the sum of $296,168 are appropriated to the Department of Public Safety, Safety Administration Division 30-01and the Department of Public Service, Refuse Collection Division 59-02 as follows:

Section 3. That the monies appropriated in the foregoing Section 3 shall be paid upon orders of the Directors of Public Safety and Public Service; and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
 
Section 4. That from the reason stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetos the same.
