NORTH CENTRAL AREA COMMISSION RECOMMENDATION: Approval.
CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of one undeveloped parcel in the R, Rural District. The requested Council variance will allow a two-unit dwelling, which is not an allowable use in the R district. Variances to required parking, area requirements, and minimum side yard, are also included in this request. The site is located within the planning boundaries of the North Central Plan (2002), which recommends “Single-Family Residential” land uses at this location. Although the proposed development exceeds the Plan’s recommendation, Staff supports the proposal as it is consistent with the Plan’s objectives of providing appropriate housing and a variety of housing opportunities, and also promoting and supporting the development of housing for all economic levels, and will not add an incompatible use to the area. Additionally, the proposed two-unit dwelling is consistent with residential uses in the area.

To grant a Variance from the provisions of Section 3332.02, R-rural district; 3312.49, Required parking; 3332.06, R-rural area district requirements; and 3332.26, Minimum side yard permitted, of the Columbus City Codes; for the property located at 2111 SAGAMORE RD. (43219), to allow a two-unit dwelling with reduced development standards in the R, Rural District (Council Variance #CV25-023).

WHEREAS, by application #CV25-023, the owner of property at 2111 SAGAMORE RD. (43219), is requesting a Council variance to allow a two-unit dwelling with reduced development standards in the R, Rural District; and
WHEREAS, Section 3332.02, R-rural district, only allows single-unit dwellings, while the applicant proposes a two-unit dwelling; and
WHEREAS, Section 3312.49, Required parking, requires two parking spaces for each dwelling, for a total of four parking spaces, while the applicant proposes two total parking spaces; and
WHEREAS, Section 3332.06, R-rural area district requirements, requires that a principal building shall be situated on a lot of no less than five acres in area, while the applicant proposes to develop a two-unit dwelling on a single 0.21± acre lot; and
WHEREAS, Section 3332.26, Minimum side yard permitted, requires that the minimum side yard be no less than 7.5 feet, while the applicant proposes a reduced side yard of 5.5 feet along the western property line; and
WHEREAS, the North Central Area Commission recommends approval; and
WHEREAS, the City Departments recommend approval because the requested variance will result in housing that is similar to the existing style, site design, and density of the surrounding neighborhood, and does not introduce an incompatible use to the area; and
WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed two-unit dwelling; and
WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and
WHEREAS, the granting of said variance will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 2111 SAGAMORE RD. (43219), in using said property as desired; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That a variance from the provisions of Section 3332.02, R-rural district; 3312.49, Required parking; 3332.06, R-rural area district requirements; and 3332.26, Minimum side yard permitted, of the Columbus City Codes; is hereby granted for the property located at 2111 SAGAMORE RD. (43219), insofar as said section prohibits a two-unit dwelling in the R, Rural District; with a parking space reduction from four required spaces to two provided spaces; a reduced lot size from five acres to 0.21± acres; and a reduced minimum side yard from 7.5 feet to 5.5 feet along the western property line; said property being more particularly described as follows:
2111 SAGAMORE RD. (43219), being 0.21± acres located on the south side of Sagamore Road, 61± feet east of Woodland Avenue, and being more particularly described as follows:
Situated in the State of Ohio, County of Franklin, and in the city of Columbus.
Being Lot Number Two [2] of Amvet Section of Arlington Park, as the same is numbered and delineated upon the recorded plat thereof, of record in Plat Book 23, Page 5, Recorder’s Office, Franklin County, Ohio.

SECTION 2. That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a two-unit dwelling, in accordance with the submitted site plan, or those uses allowed in the R, Rural District.
SECTION 3. That this ordinance is further conditioned on the subject site being developed in general conformance with the site plan and elevation plan titled, “ARCHITECTURAL SITE PLAN” and “BUILDING ELEVATIONS”, dated May 14, 2025, and March 12, 2025, respectively, and signed by Joshua Tomey, the Applicant. The plans may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed. Any slight adjustments to the plans shall be subject to review and approval by the Director of the Department Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.
SECTION 4. That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed two-unit dwelling.
SECTION 5. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
