Explanation
 
BACKGROUND:  To change the Company Name and Federal Identification number for contract number FL003757 for the purchase of HD Truck Body, Welding, Fabrication, and Collision Services, FL003991 for the purchase of HD Specialty Services, and SA003054/File 0247-2009 for the purchase of Auto Body Repair Services for Fleet Management.  This ordinance authorizes the assignment of all past, present and future business resulting from FL003757, FL003991, and SA003054/File 0247-2009 by the City of Columbus with Burns Body Shop, FID 311327701 to PBA Body Shop DBA Burns Body Shop, FID 611578173.  CC# active through 3-2-11.
 
1. Amount of additional funds:  No additional funds are necessary to modify the option contract.
2. Reason additional needs were not foreseen: PBA Body Shop DBA Burns Body Shop purchased Burns Body Shop
3. Reason other procurement processes not used: The same services are required as originally bid. No lower pricing/more attractive terms and conditions are anticipated through rebidding at this time.
4. How cost was determined:  Terms and conditions are in accordance with the original agreement.
 
FISCAL IMPACT: No funds are required to modify these option contracts.  Fleet Management must set aside their own funding for their estimated expenditures.
 
In order to maintain uninterrupted services to City agencies using this Universal Term Contract, this ordinance is being submitted as an emergency.
 
 
Title
 
To authorize and direct the Finance & Management Director to modify past, present and future purchase orders with Burns Body Shop, to reflect a name change and Federal Identification number change to the company; and to declare an emergency.
 
 
Body
 
WHEREAS, the Finance & Management Department/Purchasing Office established the contracts with Burns Body Shop for the option to purchase HD Truck Body, Welding, Fabrication, and Collision Services, HD Specialty Services, and Auto Body Repair Services;  and
 
WHEREAS, PBA Body Shop DBA Burns Body Shop purchased Burns Body Shop and the name and FID number changed, in addition to notifying the City of the change, PBA Body Shop DBA Burns Body Shop has agreed to honor the past, present and future purchase orders established from contract number FL003757, FL003991, and SA003054/File 0247-2009; and
 
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department/ Purchasing Office in that it is immediately necessary to modify contract number FL003757, FL003991, and SA003054/File 0247-2009, thereby preserving the public health, peace, property, safety, and welfare, now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1. That the Finance & Management Director be and is hereby authorized and directed to modify contract FL003757, FL003991, and SA003054/File 0247-2009 and all past, present and future purchase orders pursuant to the contracts to reflect the change of the company name and FID number from Burns Body Shop, FID 311327701 to PBA Body Shop DBA Burns Body Shop, FID 611578173.
 
SECTION 2. That this modification is in accordance with Section 329.16 of the Columbus City Codes.
 
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
