AN03-027
BACKGROUND:      This ordinance is submitted to present to Council the transcript of proceedings and papers relating to Annexation AN03-027 a certain petition for annexation as described in the ordinance and transcript which is attached hereto. More than sixty days have elapsed since November 24, 2003, the date of receipt from the Board of County Commissioners of Franklin County.
 
These are submitted in accordance with the Ohio Revised Code.
 
FISCAL IMPACT:      Provision of municipal services for a proposed annexation area has no fiscal impact.  However, provision of the stated services does represent cost to the city.  The annexation of land also has the potential to create revenue to the city.
 
 
 
 
Title
 
To accept the application (AN03-027) of LINSUE Inc., et al. for the annexation of certain territory containing 1.289 ± Acres in Clinton Township.
 
 
Body
 
WHEREAS,   a petition for the annexation of certain territory in Clinton Township was duly filed by LINSUE Inc., et al. on October 8, 2003; and
 
WHEREAS,  the said petition was duly considered by the Board of County Commissioners of  Franklin County, Ohio, and the annexation of said hereinafter described territory to the city of Columbus was approved by said Commissioners by order dated November 18, 2003; and
WHEREAS,  the Board of County Commissioners of  Franklin County certified the transcript of the proceedings in connection with the said annexation with the map and petition required in connection therewith to the City Clerk who received the same on November 24, 2003; and
WHEREAS,  sixty days from the date of said filing have now elapsed in accordance with the provisions of the Ohio Revised Code; and
 
WHEREAS,  it is in the best interest of the city of Columbus to accept the annexation of the territory sought to be annexed by the aforesaid petition; now, therefore,  
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
Section 1.  That the proposed annexation as applied for in the petition of LINSUE Inc., et al. being the majority of owner(s) of real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Franklin County, Ohio October 8, 2003 in which said petition prayed for annexation to the city of Columbus, Ohio, of certain territory adjacent thereto as hereinafter described, and which said petition was approved for annexation to the city of Columbus by the Board of County Commissioners by order dated November 18, 2003, be and the same is hereby accepted and said territory is hereby annexed to the city of Columbus.  Said territory is described as follows:
 
Situated in the State of Ohio, County of Franklin, Township of Clinton, being all of three tracts of land known as Parcels #130-005987, #130-011823, and #130-011822 deeded to Linsue, Inc. in D.B. 3571, page 388, all of a tract of land known as Parcel #130-007051 deeded to B.R. and S.M Wear in O.R. 34372, B12, all of a tract of land known as Parcel #130-007061 deeded to B.R. Wear in O.R. 3691, B04, and all of the road right-of-way along the frontage of said Parcels, said 1.289 acres being more particularly bounded and described as follows:
 
Beginning at the southwest corner of said Parcel #130-005987, the southeast corner of a tract of land known as Parcel #130-001388 deeded to Thomas R Eggers in O.R. 13543, G05, in the north line of an alley as shown in the Plat of Lincoln Heights Addition of record in Plat Book 7, page 250;
 
Thence NORTHERLY along the westerly line of said Parcel #130-005987, the easterly line of said Parcel #130-001388 a distance of 200.5 feet, crossing the southerly right-of-way of Chambers Road, to a point on the existing northerly right-of-way of said Chambers Road, said point being in the existing City of Columbus Corporation line created by Ordinance #972-95 and as recorded in M. R. 166, page 716;
 
Thence EASTERLY along said existing Corporation line, and said northerly right-of-way of Chambers Road,  a distance of 280 feet to a point at the northeast corner of said Parcel #130-011822, the northwest corner of a tract of land known as Parcel #130-005039 deeded to R.L. and A.J Hines in Instrument #199902120037867;
 
Thence SOUTHERLY along the easterly line of said Parcel #130-005987, the westerly line of said Parcel #130-005039 a distance of 200.5 feet to the southeast corner of said Parcel #130-005987, the southwest corner of said Parcel #130-005039, and in the northerly line of said alley;
 
Thence WESTERLY along the northerly line of said alley, the southerly lines of said subject Parcels a distance of 280 feet to the TRUE PLACE OF BEGINNING containing 1.289 acres , more or less, as calculated by the above courses.
 
Section 2.  That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
