Explanation
Background: This legislation will authorize the Director of Recreation and Parks to modify the contract with McMillen Paving & Sealing, Inc. for additional construction services related to the Hayden Park Improvements Project. Modification to the existing park property includes a new walking path, picnic tables and additional trees.
The original contract bid of $28,750.00 came in at well under the budget of $50,000.00 that was awarded to the community through an UIRF grant. However, the initial contingency of $10,000.00 was insufficient to cover the additional cost of resurfacing the parking area. The decision was made to use some of these remaining funds for resurfacing to make the parking area more usable for access to the walking path as well as a more welcoming access to the I-670 Multi-Use Trail.
The amount of this modification is $7,965.00 bringing the total modified contract cost to $46,715.00.
The Contract Compliance Number for McMillen Paving & Sealing, Inc. is #31-1172807. Contract compliance is good through 08/25/10.
Emergency legislation is necessary so that the work can be completed on the current contract.
Fiscal Impact: $7,965.00 is required and budgeted in the Voted 1999/2004 Recreation and Parks Bond Fund to meet the financial obligation of this contract modification.

To authorize and direct the Director of Recreation and Parks to modify the contract with McMillen Paving & Sealing, Inc. for additional construction services related to the Hayden Park Improvements Project, to authorize the expenditure of $7,965.00 from the Voted 1999/2004 Recreation and Parks Bond Fund, and to declare an emergency. WHEREAS, the Recreation and Parks Department desires to modify the contract with McMillen Paving & Sealing, Inc. for additional resurfacing work, picnic tables and trees for the Hayden Park Improvements Project; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to modify the contract with McMillen Paving & Sealing, Inc. in order to allow for the work to be completed; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Recreation and Parks be and he is hereby authorized and directed to modify the contract with McMillen Paving & Sealing, Inc. for additional construction services for the Hayden Park Improvements Project.
SECTION 2. That the expenditure of $7,965.00, or so much thereof as may be necessary, be and is hereby authorized from the Voted 1999/2004 Recreation and Parks Bond Fund No. 702, Dept. 51-01, as follows, to pay the cost thereof.

SECTION 3. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this legislation.
SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
