Rezoning Application Z08-006
 
APPLICANT:  Fritz Rumer Cooke Company, Inc.; c/o Jeff Casto; 635 East Woodrow Avenue; Columbus, OH 43207.
 
PROPOSED USE:  Manufacturing, commercial and/or office development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on April 10, 2008.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The 0.75± site is zoned R-4, Residential District, with a small portion of the site zoned M, Manufacturing District.  The applicant requests the M, Manufacturing District for the entire parcel so that it can be governed under one zoning application.  The requested M, Manufacturing District will allow manufacturing and/or commercial development.  The site is one of few remaining residentially zoned properties on the south side of Woodrow Avenue, which is predominantly zoned in the M, Manufacturing District. The site is located within the planning area of the South Side Plan (2002) which recommends industrial development for this location.  The proposed M, Manufacturing District is consistent with the zoning and development patterns of the area, and with the land use recommendations of the South Side Plan.

WHEREAS, application #Z08-006 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.75± acres from R-4, Residential, and M, Manufacturing Districts, to M, Manufacturing District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS,  an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to pass this ordinance to begin construction as soon as possible for the immediate preservation of the public peace, property, health and safety; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the proposed M, Manufacturing District is consistent with the zoning and development patterns of the area, and with the land use recommendations of the South Side Plan (2002), now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
647 EAST WOODROW AVENUE (43207), being 0.75± acres located on the south side of East Woodrow Avenue, and being more particularly described as follows:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, and being the East half of Lot number nine (9) of Nathaniel Marion's subdivision of a part of Half Section number 41, section number 27, township 5, range 22, Refugee Lands, as recorded the Recorder's Office, Franklin County, OH, in Platt Book number 1, page 305 to which record reference is made for greater certainty.
 
To Rezone From: R-4, Residential, and M, Manufacturing Districts,
 
To: M, Manufacturing District
 
SECTION 2.  That a Height District of thirty-five (35) feet is hereby established on the M, Manufacturing District on this property.
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
