BACKGROUND:  This ordinance authorizes the Finance and Management Director to enter into a contract on behalf of the Office of Construction Management with Meggitt Training Systems for the renovation of the Police indoor shooting range equipment at the Police Complex, 2609 McKinley Avenue.
 
The renovation of the indoor shooting range will upgrade the targeting and trap system.  The last major renovation of the indoor range occurred approximately 20 years ago.  The current targeting and trap system has been heavily used and is in need of replacement.   Continued use of the current system may prove hazardous to trainers and officers conducting firearms certifications due to the age of the trap system, which is well-worn, and the need to manually remove spent shells and casings, many of which release lead as a by-product of live fire testing on the range.  The new targeting and trap system will ensure safe use of the range and use automation to remove the spent shells and casings.
 
The original bid specifications drafted by the City did not include a rifle rated safety ceiling or a running target.  After consultation with the Division of Police and Construction Management, it was determined that funds are available to include the rifle rated ceiling and the running target.  Both items can be supplied by the bidder.  The rifle rated ceiling is a safety issue and the running target will enhance Police training.  It is advantageous to include both the rifle rated ceiling and the running target as part of this renovation rather than bid separately which may make installation more expensive.   Therefore, we are requesting that City Council waive the competitive bidding provisions of the Columbus City Code to allow for installation of the rifle rated ceiling and the running target as part of this renovation.   
 
Formal bids were solicited and one company submitted a bid on April 21, 2011 as follows (0 MBE,0 FBE):
 
Meggitt Training Systems       $1,382,528.00
 
The Office of Construction Management recommends the bid be awarded to Meggitt Training Systems and it is a responsive and responsible bidder.
 
Emergency action is requested due to the lead-time in ordering materials and the need for these renovations to occur as soon as practical.   
 
Meggitt Training Systems Contract Compliance No. 58-2272995, expiration date March 29, 2013.
 
Fiscal Impact:  A current unencumbered cash balance of $8,584.00 is available from the Gov'l B.A.B's (Build America Bonds).  An additional $1,485,287.00 will be transferred between projects within the Department of Public Safety's Gov'l B.A.B.'s (Build America Bonds) Fund.

WHEREAS, it is necessary to amend the 2011 Capital Improvements Budget and transfer cash between projects within the Department of Public Safety's Gov'l B.A.B.'s (Build America Bonds) Fund, to provide sufficient funds in the appropriate project area for this expense; and
 
WHEREAS, it is necessary for the renovation of the Police indoor shooting range equipment at the Police Complex, 2609 McKinley Avenue to occur; and
 
WHEREAS, formal bids were solicited and one company submitted a bid, Meggitt Training Systems, and is a responsive and responsible bidder; and
 
WHEREAS, it is in the best interest of the Finance and Management Department, Office of Construction Management, to waive the competitive bidding requirements of the Columbus City Codes; and
 
WHEREAS, an emergency exists in the usual daily operations of the Finance and Management Department, Office of Construction Management in that it is immediately necessary to authorize the Finance and Management Director to enter into a contract with Meggitt Training Systems for the renovation of the Police indoor shooting range equipment due to the lead-time in ordering materials and the need for these renovations to occur as soon as practical, thereby preserving the public health, property, safety, and welfare, now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the 2011 Capital Improvement Budget is hereby amended as follows:

SECTION 6.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
SECTION 7. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
