Explanation
BACKGROUND: This legislation authorizes the Director of Public Utilities to enter into a contract for the installation of a street lighting system with underground wiring under the assessment procedure. Property owners have submitted a petition for a high pressure sodium street lighting system with ornamental poles and underground wiring for Longview Avenue between High Street and Calumet Street.
Resolution Number 204X-02, adopted December 2, 2002, authorized the preparation of plans and specifications. Emergency legislation of necessity, Resolution No. 110X-03, was adopted June 6, 2003. Ordinance Number 2664-2003, determining to proceed, was passed January 12, 2004.

All of the above stated costs are estimates except the construction costs that are based upon bids received and opened by the Director of Public Utilities on March 24, 2004.
Five responsive bids were received, one from a female business enterprise and four from majority business enterprises, as follows:

The engineer's estimate for the project construction was $67,569.81.
The Division of Electricity recommends an award to U.S. Utility Contractor Company, a female business enterprise, in the amount of $44,953.19, as the lowest responsive and responsible bid received. Their Contract Compliance Number is 341606689.
Emergency action is requested due to citizens' approved petition for a timely implementation of construction services.
FISCAL IMPACT: The entire cost of this project shall be assessed to the property owners.

To authorize the Director of Public Utilities to enter into a contract with U.S. Utility Contractor Company for the installation of a street lighting system with underground wiring on Longview Avenue under the assessment procedure; to authorize the expenditure of $86,000.00 from the Street Lighting Assessment Fund; and to declare an emergency. WHEREAS, property owners have submitted a petition for a high pressure sodium street lighting system with ornamental poles and underground wiring on Longview Avenue between High Street and Calumet Street; and
WHEREAS, U.S. Utility Contractor Company submitted the lowest responsive and responsible bid opened by the Director of Public Utilities on March 24, 2004 for the installation of the aforesaid street lighting system; and
WHEREAS, funding is necessary to pay for construction costs, design, construction inspection, engineering, advertising and printing, and any other miscellaneous expenses for said project; and
WHEREAS, emergency action is necessary due to citizens' approved petition for a timely implementation of construction services; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Electricity, in that it is immediately necessary to enter into a contract for labor and material for the construction of street lighting improvements for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Public Utilities is hereby authorized to enter into a contract with U.S. Utility Contractor Company, in the amount of $44,953.19, and to obtain and pay for the services of the Division of Electricity, the Transportation Division, and any services of other City divisions as may be necessary to complete the street lighting system for Longview Avenue.
SECTION 2. That to pay the cost of the aforesaid contract and expenses, the expenditure of $86,000.00, or so much thereof as may be needed, be and is hereby authorized from Division of Electricity, Division No. 60-07, Fund No. 580, Subfund No. 984, OCA 580984, Object Level Three 6625.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
