Explanation
 
Need:
This legislation authorizes the Department of Finance and Management to establish a contract pursuant to specified requirements establish in SA001545 GRW to purchase police motorcycles from the Capital South Fund number 481.   The new motorcycles will replace old and deteriorated ones that have exceeded their useful lives and are no longer efficient as front line police vehicles.
 
The Department of Public Safety, Division of Police, is requesting that the Director of Finance and Management create a contract with Renegade Harley Davidson to furnish three (3) Harley Davidson motorcycles.
 
Since there is not enough time to obtain formal bids to satisfy the need to purchase motorcycles this calendar year, competitive bidding must be waived.
 
Renegade Harley Davidson was the successful bidder on the 2005 Police Motorcycle bid that satisfied all of the criteria required by the Columbus Division of Police (complete equipment package). Renegade Harley Davidison has guaranteed the pricing for the 2006 Police Motorcycles along with all required equipment at the 2005 bid price. This arrangement reduces the delivery date by approximately six months. The contract with Renegade Harley Davidson will cost $71,100.00.

Emergency Designation: Emergency legislation is needed to make the funds available as soon as possible because of the need to keep current pricing that expires on December 31, 2005 and to expedite delivery time of these vehicles.
 
FISCAL IMPACT: The funding source of this purchase is the Capital South Fund, number 481.  This arrangement eliminates the need to use General Funds for the purchase of Police motorcycles in 2006.

Body
 
WHEREAS, a need exists to purchase motorcycles for the Division of Police due to shortage of motorcycles for daily operations; and
 
WHEREAS, Renegade Harley Davidson was the successful bidder on the 2005 Police Motorcycle bid and has guaranteed to hold pricing; and
 
WHEREAS, it is necessary to waive the provisions of Section 329.06 of the Columbus City Code; and
 
WHEREAS, an emergency exists in the usual and daily operation of the Department of Public Safety,  in that it is immediately necessary to enter into contract to purchase police motorcycles to expedite delivery and hold current pricing, for the immediate preservation of the public health, peace, property, safety and welfare, now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Finance and Management Director be and is hereby authorized and directed to enter into a contract for purchase of police motorcycles from Renegade Harley Davidson based on them holding current pricing from previous contract.
 
Section 2.  That in accordance with Section 329.27 of Columbus City Codes, this Council finds it is in the best interest of the City of Columbus to waive the provisions of Section 329.06 of the Columbus City Codes to permit the aforementioned purchases.
 
Section 3.  That the appropriation and expenditure of  $71,100.00 or so much thereof as may be needed, be and same is hereby authorized as follows:
