Explanation
 
There is a need to acquire the Immersive Video Intelligence Network System from the Ohio University's School of Media Arts and Studies for the Division of Police. The Immersive Video Intelligence Network (IVIN) is a proprietary design, software set, and production system of Ohio University's School of Media Arts and Studies and Game Research and Immersive Design (GRID) Lab.  Ohio University is the only institute capable of developing, licensing, and deploying the IVIN system in the world.  No other company or institute, public or private, is developing products or services similar to the IVIN system.  
 
This recently developed immersive video/photo technology simultaneously captures images that are "stitched" together to create a seamless virtual reality experience.  This emergency preparedness technology creates accurate models of buildings and other sites considered at risk for terrorist attacks, hostage situations or other populated disasters.  First responders will use this system to navigate through video data to assess crisis situations and design appropriate response.   This media will capture critical infrastructure of the top 100 sites identified by the Columbus Police TEW, which fall within the Central Ohio Urban Area Security Initiative (UASI) Jurisdiction.  This video data collection will be entered and stored in a national database (ACAMS) as mandated by the U.S. Department of Homeland Security, as directed by the National Response Plan and National Infrastructure Protection Plan.  An Intergovernmental Agreement was executed on 3/04/2008 between the Franklin County Board of Commissioners and the City of Columbus, (Ordinance 1691-2006, passed 10/18/2006) to provide for the administration of the subgrant awards in order to expeditiously acquire and pay for the services and equipment sought to be obtained pursuant to the sub-grant award.  This project is being administered by the Franklin County Office of Homeland Security & Justice Programs under the FY 2007 Urban Area Security Initiative (UASI).  The total expenditure of $702,000.00 will be paid by Franklin County through the Urban Area Homeland Security Grant.
 
Bid Information:  Ohio University's School of Media Arts and Studies is the only institute capable of developing. licensing, and deploying the IVIN system; therefore this purchase will be made in accordance with sole source procurement.
 
EMERGENCY DESIGNATION:  Emergency legislation is necessary to meet federal grant deadlines and permit sub-grantee award processing.
 
FISCAL IMPACT:  There is no fiscal impact for the General Fund Account.   The Intergovernmental Agreement permits the City of Columbus and Franklin County to complete the sub-grant processing prior to the expenditure of project funds.

Body
 
WHEREAS, the Government of the United States of America has created funding resources through the State Homeland Security Program (SHSP) and Urban Area Security Initiative (UASI) to enhance the ability of State and local agencies to prevent, deter, respond to and recover from threats and incidents of terrorism involving the use of chemical, biological, radiological, nuclear and explosive (CBRNE) weapons and cyber attacks; and
 
WHEREAS, representatives of the City of Columbus and Franklin County entered into an Intergovernmental Agreement to provide for the administration of the State Homeland Security Program (SHSP) and Urban Area Security Initiative (UASI) federal funding available to the City of Columbus through Sub-grantee awards; and
 
WHEREAS, federal grant deadlines and the need to expedite sub-grantee processing require that this agreement be completed at the earliest possible time so this ordinance is being submitted as an emergency measure; and
 
WHEREAS, it is in the best interest of the City to enter into this contract in accordance with provisions of Section 329.07 (e) (Sole Source) of the Columbus City Codes, 1959; and
 
WHEREAS, an emergency exists in the usual and daily operation of the Division of Police, Department of Public Safety, in that it is immediately necessary to execute those documents necessary for the acquisition of the Immersive Video Intelligence Network system for the Division of Police to meet federal grant deadlines and permit sub-grantee award processing and for the preservation of the public peace, health, safety and welfare, now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Safety be and hereby is authorize to execute those documents necessary for the acquisition of the Immersive Video Intelligence Network system from the Ohio University's School of Media Arts and Studies and Game Research and Immersive Design (GRID) Lab, utilizing the Homeland Security Grant in accordance with C.C.C. Section 329.04 (l) Not for Profit Contract.
 
SECTION 2.  That said agreement shall be awarded in accordance with provisions of Section 329.07(e) (Sole Source) of the Columbus City Code, 1959.
 
SECTION 3.  That for reasons stated in the preamble hereto, which is hereby made a part thereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
